I � 76 58 <br /> AN ORDINANCE LIMITING THE DISCHARGE OF A FIREARM IN ORANGE COUNTY <br /> Pursuant to North Carolina General Statutes, Section <br /> 153A-129, the Board of County Commissioners of Orange County <br /> ordains that: <br /> SECTION I. <br /> It shall be unlawful for any person to discharge a <br /> firearm outside the corporate limits of any municipality within <br /> Orange County except in defense of person or property, provided, <br /> however, that this ordinance shall not be applicable to: <br /> • A: The discharge of a firearm by any law enforcement <br /> officer in the course and scope of such officer's duties <br /> • as a law enforcement officer or by any other person <br /> • <br /> acting pursuant to the lawful directions of any law <br /> enforcement officer; <br /> B. The discharge of a firearm on one's own land or on <br /> the lands of another with the prior consent of such <br /> • landowner so long as the discharge of the firearm is in <br /> such a manner as to prevent the travel of the projectile, <br /> missile, bullet, shot, etc. , onto the land of another; <br /> C. The discharge of a firearm for any lawful hunting <br /> purposes, provided that such discharge is upon one's own <br /> land or upon the land of another with the prior per- <br /> • mission of the owner or possessor of said land. <br /> SECTION II. <br /> In no event shall the discharge of any firearm permitted <br /> under Sections I(B) or (C) be lawful within 50. feet of any public <br /> street, public building, or within 200 feet of the occupied <br /> dwelling of another without such other land owner's prior express <br /> permission. <br /> SECTION III. <br /> Any person who violates the provision of this ordinance <br /> shall be guilty of a misdemeanor and shall, upon conviction, be <br /> WINSTON, COLEMAN <br /> AND BERNHOLZ fined or imprisoned, or both, in the discretion of the Court. <br /> ATTORNEYS AT LAW <br /> CHAPEL HILL,N.C. <br /> HILLSBOROUGH,N.C. <br /> • <br />
