49 <br /> 11 <br /> Sec. 11-136. Public property defined. <br /> For purposes of this Article, the term "public property" shall <br /> include, but not be limited to: <br /> a. any privately owned public vehicular area as identified in N. <br /> C. General Statute Sec. 160A-301 (d) where the Town has <br /> properly enacted parking regulations and, in addition, any <br /> privately owned outdoor area for which the owner has, pursuant <br /> to N. C. General Statute Sec. 14-159 . 13 , authorized Town <br /> police officers to trespass persons on said property during <br /> specified hours; provided, however, that such privately owned <br /> property shall only be considered public property for purposes <br /> of this Article if signs have been posted, in a manner <br /> reasonably likely to come to the attention of persons <br /> entering, with notice of the Town's exercise of regulatory <br /> authority. <br /> b. property owned by, or under the control of, the Town of Chapel <br /> Hill or some other government or public agency. <br /> Sec. 11-137. Exemptions. <br /> In accordance with United States Code Title 18 , Section 926A, <br /> nothing in this Article shall be construed as prohibiting any <br /> person from transporting, shipping, or receiving a firearm for any <br /> lawful purpose from any place where he may lawfully possess and <br /> carry such firearm to any other place where he may lawfully possess <br /> and carry such firearm if, during such transportation the firearm <br /> is unloaded, and neither the firearm nor any ammunition being <br /> transported is readily accessible or is directly accessible from <br /> the passenger compartment of such transporting vehicle: Provided, <br /> that in the case of a vehicle without a compartment separate from <br /> the driver's compartment the firearm or ammunition shall be <br /> contained in a locked container other than the glove compartment or <br /> console. <br /> Sec. 11-131. Conflict of Laws. <br /> If any portion of this Article shall be preempted or otherwise <br /> declared invalid by any <br /> state or federal authority, such action <br /> shall not operate to invalidate the rest of this Article and the <br /> same shall remain in full force and effect. <br /> Sec. 11-139. Enforcement and Penalties. <br /> a. Criminal penalties. Violation of any provision of this <br /> Article shall be a misdemeanor and shall be subject to a fine <br /> of $500 or imprisonment for not more than 30 days. <br /> is <br />
