44 <br /> 6 <br /> AN ORDINANCE ENACTING ADDITIONAL TOWN REGULATIONS OF FIREARMS <br /> BE IT ORDAINED by the Council of the Town of Chapel Hill as <br /> follows : <br /> Section 1. Chapter 11 of the Town Code is hereby amended by adding <br /> a new Article XIV to read as follows: <br /> ARTICLE XIV. ADDITIONAL RESTRICTIONS ON POSSESSION <br /> AND DISPLAY OF FIREARMS <br /> Sec. 11-130. Findings and Purposes. <br /> The Town Council does hereby find that: <br /> a. North Carolina law authorizes cities and towns, within <br /> statutory and constitutional limitations, to regulate the use <br /> and display of firearms. <br /> b. North Carolina law authorizes cities and towns, within <br /> statutory and constitutional limitations, to prohibit the <br /> possession of weapons or instrumentalities of mass death and <br /> destruction. <br /> c. North Carolina law authorizes cities and towns, within <br /> statutory and constitutional limitations, to define, prohibit, <br /> regulate or abate acts or conditions detrimental to the <br /> health, safety, and welfare of their citizens and the peace <br /> and dignity of their communities. <br /> d. The proliferation and use of small, readily concealed handguns <br /> and the proliferation and use of semi-automatic weapons create <br /> an ever-increasing danger of violence and crime, especially <br /> because of an increase in drug-related crimes, and pose a <br /> serious threat to the health, safety, and welfare of the <br /> citizens of Chapel Hill. <br /> e. Semi-automatic weapons are primarily designed to be used as <br /> anti-personnel weapons. The lawful civilian application or <br /> use of such weapons is merely incidental to such primary anti- <br /> personnel purposes. <br /> f. Semi-automatic weapons, which are not prohibited by State law, <br /> can be virtually as great a threat to the health, safety, and <br /> welfare of the citizens of Chapel Hill as fully automatic <br /> weapons, which are prohibited by State law. Fully automatic <br /> weapons which can discharge a 30-round magazine in two seconds <br /> can discharge the same magazine, if operated as semi-automatic <br />
