41 <br /> 3 <br /> 4 . Display of small handguns. <br /> Section 11-134 would prohibit the display of small handguns on <br /> the public streets, sidewalks, alleys and other public <br /> property. Small handguns, those which are easily and <br /> ordinarily carried concealed, are defined as those under six <br /> inches in length and firearms without handgrips under eight <br /> inches in length. The ordinance includes the method of <br /> determining the length of these weapons. <br /> 5 . Possession of weapons of mass death and destruction. <br /> Section 11-135 would prohibit the possession, off one's own <br /> premises, of a weapon of mass death and destruction. The <br /> ordinance includes a detailed definition of a "weapon of mass <br /> death and destruction. " Included within the definition are: <br /> a. semi-automatic rifles accepting a detachable magazine <br /> which can hold more than 20 rounds of ammunition; <br /> b. semi-automatic shotguns with a magazine capacity of more <br /> than six rounds; and, <br /> c. semi-automatic handguns which are: <br /> modifications of prohibited semi-automatic rifles; <br /> designed to accept a magazine with a capacity of more <br /> than 20 rounds; and, <br /> actually possessed while a detachable magazine with a <br /> capacity of more than 20 rounds is attached or easily <br /> available to be attached. <br /> The definition of "weapon of mass death and destruction" was <br /> developed primarily from ..,the definition of "assault weapon" <br /> contained in an ordinance enacted by the City of Cleveland, Ohio. <br /> Cleveland's ordinance was upheld in August by the Supreme Court of <br /> Ohio as being valid under the Constitutions of Ohio and the United <br /> States. (Arnold v. Cleveland, 67 Ohio St. 3d 35, 616 N. E. 2d 163 <br /> (1993) ) . The definition is drawn to exclude commonly used semi- <br /> automatic hunting weapons and has been reviewed by persons familiar <br /> with firearms. <br /> Further, the definition of "weapon of mass death and destruction" <br /> does not include weapons, including automatic weapons, which are <br /> defined as weapons of mass death and destruction by State law and <br /> prohibited by State law. <br />
