11 <br /> 4 <br /> b. N. C.G.S. Sec. 14-32 , which defines the offense of assault <br /> with a deadly weapon with intent to kill . <br /> c. N. C.G.S. Sec. 14-34 . 1, which defines the offense of <br /> discharging a barreled weapon or firearm into occupied <br /> property. <br /> d. N. C. G. S. Sec. 14-32 . 1, which defines as a specific <br /> offense the assault of a handicapped person with a deadly <br /> weapon. <br /> e. N. C.G.S. Sec. 14-34 . 2 and 14-288 . 9, which define as <br /> specific offenses the assault with a weapon on law <br /> enforcement, fire and/or emergency personnel . <br /> f. N. C.G.S. Sec. 14-87, which defines armed robbery as <br /> robbery with the use or threatened use of a firearm or <br /> other dangerous weapon. <br /> g. N.C.G.S. Sec. 14-34, which defines as an assault the <br /> intentional pointing of a gun at another "either in fun <br /> or otherwise, whether such gun or pistol be loaded or not <br /> loaded. " <br /> 4 . State Permitting Regulations. <br /> Article 52A of Chapter 14 of the General Statutes requires a permit <br /> to be issued by the sheriff of Orange County before a pistol can <br /> be sold or transferred, purchased or received by any purchaser or <br /> receiver who resides in Orange County. Prior to issuance of such <br /> a permit the sheriff is required to be fully satisfied as to the <br /> good moral character of the applicant. Permits may not be issued <br /> to persons convicted of certain offenses, users of certain drugs <br /> and persons adjudged mentally incompetent. <br /> • <br /> C. Common Law Offense <br /> In addition to the statutory criminal offenses related to weapons <br /> listed above, North Carolina recognizes the common law offense of <br /> "going armed to the terror of the people. " The elements of this <br /> offense are: <br /> a. arming oneself with unusual and dangerous weapons <br /> ( including any gun) ; <br /> b. for the purpose of terrifying others; <br /> c. going on the public highways; <br /> • <br />
