43 <br /> 6.23.12 CLUSTERING <br /> DISTRICT CLUSTERING REQUIREMENTS <br /> UNIV-CA Clustering of residential lots is permitted in accordance with Section IV- <br /> UNIV-PW B-10 of the Orange County Subdivision Regulations, with the additional <br /> provision that each lot contains a minimum of one acre. <br /> All Other Clustering of residential lots is permitted in accordance with Section IV- <br /> Overlay B-10 of the Orange County Subdivision Regulations. <br /> Districts <br /> 6.23..13 APPLICABILITY <br /> a) Existing Development <br /> Existing development is not subject to the requirements of this Article. Existing <br /> developments include projects that are built, or at a minimum have established a <br /> vested right under North Carolina zoning law as of January 1, 1994 based on at <br /> least one of the following criteria: <br /> 1. substantial expenditures of resources (time, labor, money)based on a good <br /> faith reliance upon having received a valid local government approval to <br /> proceed with the project; or <br /> 2. having an outstanding valid building permit; or <br /> 3. having expended substantial resources and having an approved site specific <br /> or phased development plan. <br /> b) Redevelopment <br /> Non-residential redevelopment is allowed if the rebuilding activity does not have <br /> a net increase in built-upon area or provides equal or greater stormwater control <br /> than the previous development. There are no restrictions on single-family <br /> redevelopment. <br /> c) Expansion of Existing or New Developments <br /> Expansions to structures classified as existing development must meet the <br /> requirements of this Article, however, the impervious surface and lot area <br /> involved in the existing development is not required to be included in the <br /> calculation of the impervious surface ratio. <br /> 20 <br />
