Article 12 continued from Page No. 11 <br /> 12.10 Reference subparagraph 2.6.8 - Owner and Prime Contractors shall communicate through <br /> the Architect. Communications by and with the Architect's consultants shall be through the <br /> Architect. <br /> 12.11 Reference subparagraph 2.6.9-Based on the Architect's observations of the work, site visits, <br /> and evaluations of the Prime Contractor's applications for payment, the Architect shall <br /> review and certify the amounts due the Contractors. <br /> 12.12 Reference subparagraph 3.3.3 - Preparing Change Orders and Construction Change <br /> Directives due to omissions or defective designs or specifications furnished by the Architect <br /> shall not be considered Additional Services. <br /> 12.13 Reference subparagraph 3.4.6 -Architect shall as part of Basic Services investigate existing <br /> conditions or facilities or make measured drawings to the extent necessary for design of the <br /> addition to the existing building. <br /> The Architect may generally rely on Owner furnished documents and information, such as <br /> record drawings, etc. The Architect shall not be required to perform or to have others <br /> perform destructive testing or to investigate concealed or unknown conditions. <br /> 12.14 Reference subparagraph 3.4.16 - The Architect shall prepare or provide as part of Basic <br /> Services a set of record drawings, which Owner shall be at liberty to reproduce, showing <br /> significant changes in the work made during construction, based on marked-up prints, <br /> drawings and other data furnished by the Prime Contractors to the Architect, including, but <br /> not limited to,the location of water,sewer,telephone, electric,gas and other utility lines. <br /> 12.15 Reference subparagraph 5.2.2 - In the event the lowest responsible bids exceed the funds <br /> appropriated for the project, the Architect, in consultation with, and at the direction of, the <br /> Owner, shall provide such modifications in the Contract Documents as shall be necessary <br /> to bring the cost of the Project within the Project's budget. <br /> 12.16 Reference paragraph 7.1 - The Owner and the Architect agree to endeavor to provide written <br /> notification in advance of any litigation concerning claims, disputes, and other matters in <br /> question between the parties to this Agreement arising out of or relating to this Agreement <br /> or the breach thereof. <br /> Article 12 continued on Page No. 13 <br /> 12 <br />
