00C <br /> The property is located in the Rural Buffer zoning district and <br /> University Lake Watershed. The existing quarry is designated as <br /> Extractive Use in the JPA Land Use Plan. Expansion of the <br /> Extractive Use designation to include the area proposed for the <br /> quarry expansion requires approval of an amendment to the JPA <br /> Land Use Plan. Amendments to the JPA Land Use Plan require <br /> approval of Carrboro, Chapel Hill and Orange County, as specified <br /> in the Joint Planning Agreement. If the JPA Land Use Plan <br /> Amendment is approved, then corresponding changes in Orange <br /> County Comprehensive Plan (Land Use Element) can be approved, <br /> and the applicant can submit an application for approval of a Special <br /> Use Permit. The Special Use Permit requires only the approval of <br /> the Orange County Board of Commissioners. <br /> An amendment to the Joint Planning Area Land Use Plan was <br /> presented at a JPA public hearing on October 10, 1991. Concern <br /> with potential environmental impact was raised during the public <br /> hearing process. The applicants chose to prepare and submit the EIS <br /> prior to submittal of the Special Use Permit so that more information <br /> would be available at the time of the decision on the Land Use Plan <br /> amendment. The public hearing on the EIS is being presented at <br /> this joint public hearing as a courtesy to Chapel Hill and Carrboro. <br /> Continuation of the joint public hearing for the Land Use Plan <br /> amendment proposed American Stone Quarry will be scheduled at a <br /> later date. <br /> The Environmental Impact Statement was distributed for comments <br /> through the North Carolina Clearinghouse. Comments were <br /> received from the NC Department of Transportation and the NC <br /> Wildlife Resources Commission (attached). <br /> - NCDOT requested that the right-of-way for the proposed <br /> relocation of Bethel-Hickory Grove Church Road be reserved. <br /> (The road would be constructed and right-of-way dedicated as <br /> a condition of approval if a Special Use Permit is approved.) <br /> - The North Carolina Wildlife Resources Commission <br /> (NCWRC) stated that the EIS "is generally well-written and <br /> provides much of the information needed for our review of fish <br /> and wildlife habitat impacts." However, the items summarized <br /> below were identified as needing clarification or revision: <br /> 1. The EIS describes a literature review of known <br /> populations of protected species, but no field <br /> investigation is mentioned.
