the Contractor to an increase in the Contract Price or an extension of the Contract Time, <br />the Contractor may make a claim therefore as provided in Articles 14 and/or 15 of these <br />General Conditions. <br />7.24 The Contractor shall at all times keep the premises free from accumulation of waste <br />materials or rubbish caused by the Work. At least weekly and at the completion of the <br />Work, the Contractor shall remove all waste materials and rubbish attributable to the <br />Contractor's Work from and about the Project. At the completion of the Work, the <br />Contractor shall remove all tools, construction equipment, machinery, and surplus <br />materials. The Contractor shall leave the Work in condition for occupancy by the Owner <br />such that no cleaning or other operations are required. Material cleared from the Project <br />and deposited on adjacent property shall not be considered as having been disposed of <br />satisfactorily. If the Contractor fails to keep the Project clean and free of waste materials or <br />rubbish, fails to satisfactorily clean-up weekly or at the completion of the Work, the CM may <br />do so and the costs thereof may be deducted from any amounts due or to become due the <br />Contractor. <br />7.25 Utilities, temporary facilities, and signs shall be provided as described in the Contract <br />Documents. Absent a contrary direction in the Supplementary Conditions, the Contractor <br />shall pay all bills for its consumption of water, electricity, or other public utility service to the <br />Project site. <br />7.26 The Contractor shall indemnify and hold the CM, the Owner, the Designer, the Designer's <br />consultants, and their respective officers, agents, and employees harmless against all <br />costs, damages, and expenses, including attorney's fees and costs of defense, arising out <br />of claims by any separate contractor or by any Subcontractor, sub-subcontractor, or <br />supplier engaged by or employed by the Contractor or employed by any of the <br />Subcontractors claiming through him, including without limitation damages, losses, and <br />expenses arising out of or relating to any inconvenience, delay, interference, or other action <br />or non-action of the Contractor or the Contractor's Subcontractors on the Project. <br />The Contractor acknowledges that should the Contractor or any of the Contractor's <br />Subcontractors be damaged by any breach of contract by any other separate contractor on <br />the Project, the Contractor may invoke applicable dispute resolution procedures with said <br />other separate contractor. <br />7.27 Prior to completion of the Work and Final Payment of the Contract Price, excepting only <br />those portions of the Work deemed accepted in accordance with the Contract Documents, <br />the Contractor shall have charge and care of the Work, and shall take every precaution <br />against injury or damage to any party due to the action of the elements or from any other <br />cause, whether arising from the execution or from the non-execution of the Work. The <br />Contractor shall, as required by the CM, replace, rebuild, repair, restore, and make good all <br />injury or damage to any portion of the Work occasioned by any of the above causes before <br />Final Completion and shall bear the expenses thereof. <br />7.28 In the event that the Work, or any portion thereof, is suspended at any time pursuant to an <br />order of the Owner, the Contractor shall obey all instructions of the CM regarding storage of <br />materials, drainage, protection of the Work, and erection of temporary structures during the <br />suspension period. <br />7.29 The CM shall be responsible for the coordination of the Work of the separate contractors, <br />both as to space and time. The CM shall incorporate the Contractor's Construction <br />Schedule into the Master Schedule and coordinate the implementation of the Contractor's <br />Construction Schedule.
