ORANGE COUNTY <br />BOARD OF COMMISSIONERS <br />ACTION AGENDA ITEM ABSTRACT <br />Meeting Date: June 26, 2007 <br />Action Agenda t <br />Item No. ~- ' c~ c~ <br />SUBJECT: County Campus Approval of Purchase Agreement and Construction Manager <br />at Risk Contract <br />DEPARTMENT: County Attorney & Purchasing PUBLIC HEARING: (Y/N) No <br />ATTACHMENT(S): <br />Resolution <br />Form of Purchase Agreement <br />Form of Construction Manager at Risk <br />(Due to size, these attachments are <br />available on the Board meeting. agenda <br />section of the County's website, or from <br />the Clerk's office) <br />INFORMATION CONTACT: <br />Pam Jones, (919) 245-2652 <br />Geoffrey Gledhill (919) 732-2196 <br />PURPOSE: To consider approving a Purchase Agreement(s) and Construction Manager at <br />Risk (CMAR) agreement(s) associated with the purchase and construction of facilities on the <br />county campus off of West Margaret Lane, Hillsborough. <br />BACKGROUND: On November 2, 2006, the Board of Commissioners approved an Agreement <br />of Intent for the construction and purchase of two buildings on the County campus off of West <br />Margaret Lane, essentially in the location of the-previous Southern States building. The County <br />Attorney and County staff have been working for several months with the developer and his <br />attorneys to arrive at the terms of a purchase agreement(s) for the two buildings, as well a <br />construction agreement(s) for the construction of the facilities. These agreements are presented <br />for Board of Commissioner approval. <br />Terms of the Agreement(s) are consistent with the Agreement of Intent. Highlights are <br />summarized below, with additional detail contained in the form of Agreements: <br />• Two buildings: office building approximately 46,716 square feet; and Library <br />approximately 23,454 square feet; <br />• Purchase price: $17,939,079; <br />• Land under each of the buildings, associated parking around the buildings and other <br />amenities are included in the purchase price and will be owned by the County. <br />• County will have access to a total of 246 parking spaces provided through a combination <br />of surface parking around the buildings, with the remaining spaces provided on the <br />parking deck. <br />o Note: Parking on the deck is allowed by license from the developer. An <br />agreement will be presented for consideration by the Board closer to completion of <br />parking deck construction. <br />
