EXHIBIT "A" <br /> MODIFICATIONS OF THE STANDARD MA CONTRACT DOCUMENT B141 <br /> THE FOLLOWING SECTIONS ARE MODIFIED TO READ: <br /> Article 1, paragraph 1.1.2: The Architect's services shall be performed as expeditiously as <br /> is consistent with professional skill and care and the orderly progress of the work. Upon <br /> request of the Owner,the Architect shall submit for the Owner's approval a schedule for the <br /> performance of the Architect's services which may be adjusted by mutual agreement of the <br /> Owner and the Architect, as the project proceeds, and shall include allowances for periods <br /> of time required for the Owner's review and for the approval of submissions by authorities <br /> having jurisdiction over the Project. Time limits established by this schedule approved by <br /> the Owner shall not, except for reasonably cause, be exceeded by the Architect or Owner. <br /> Neither the Architect nor the Owner shall be required to make up time lost by the other party. <br /> Article 2, paragraph 2.2.1: The Architect shall furnish a program to the Owner, as Basic <br /> Services, to ascertain the requirements of the project and shall arrive at a mutual <br /> understanding of such requirements with the Owner, and shall submit such understanding <br /> in writing, and shall furnish a copy to the Owner for its approval before proceeding with <br /> preliminary designs. <br /> Article 2, paragraph 2.4.1: Based on the approved Design Development documents and any <br /> further adjustments in the scope or quality of the Project, or in the construction budget <br /> authorized by the Owner,the Architect shall prepare,for approval by the Owner,Construction <br /> Documents consisting of Drawings and Specifications setting forth in detail the work required <br /> for the Architectural, Structural, Mechanical, Electrical, service-connected equipment, and <br /> site work, and the necessary general conditions of the Contract. He shall provide the <br /> services of Professional Structural, Mechanical, Civil and Electrical Engineers, qualified by <br /> training and experience in their respective fields as needed to address the requirements of <br /> the project as defined herein; and shall require such professional engineers to place their <br /> seal, name and signature on the drawings and specifications prepared by them. <br /> Article 2, paragraph 2.4.2: The Architect, after consultation with Owner, shall prepare the <br /> necessary bidding information and bid forms to comply with public building laws as set forth <br /> in North Carolina General Statutes Chapter 143,including the necessary information required <br /> by Chapter 87 of the North Carolina General Statutes pertaining to the licensing of <br /> contractors, and shall assist the Owner in the preparation of the conditions of the contract <br /> and the form of the agreement between the Owner and the General and Prime Contractors. <br /> Article 2, paragraph 2.4.3: The Architect shall advise the Owner of any adjustments to <br /> previous preliminary estimates of probable Construction Costs indicated by changes in scope <br /> of the work requirements or general market conditions. <br /> Add as Article 2, paragraph 2.4.5: The Architect shall include in the bidding information, <br /> plans or specifications,a requirement that Prime Contractors provide operation manuals and <br /> adequate training for the experienced staff of the Owner in the operation of mechanical, <br /> electrical, heating and air-conditioning systems installed by the Prime Contractors, as well <br /> as any specialized equipment, such as hoists, cranes,etc., which may be installed as part of <br /> the project. <br /> Add as Article 2, paragraph 2.5.2: In the event the lowest responsible bids exceed the fund <br /> appropriated for the project, the Architect, in consultation with, and at the direction of, the <br /> Owner,shall provide such modifications in the Contract Documents and/or negotiations with <br /> the low bidder as shall be necessary to bring the cost of the Project within the Project's <br /> budget. <br />
