Approval of Governor ' s Grove Subdivision <br /> Located along Governor Scott Rd. (SR 1351) ,` <br /> Dear Ms . Carter: - <br /> Per your request , this letter is a follow up to your conversation <br /> with Mr. Michael Mills , Assistant Division Maintenance Engineer <br /> regarding my last letter of 29 July, 1993 . In my letter , item number <br /> six (6) suggested a payment in lieu by the developer for the <br /> improvements required by your office on Governor Scott Rd (SR 1351) . <br /> After reviewing the proposed Secondary Road Program now pending <br /> approval by the Orange County Commissioners and the Board of <br /> Transportation and consideration of right of way availability, this <br /> office would recommend the county to require the developer to make <br /> all the required improvements as needed. <br /> Because NCDOT does not know when we will be able to pave SR 1351 nor <br /> do we know our budget restraints at this time , we can not guarantee <br /> the necessary grade improvements needed on Governors Scotts Groove in <br /> order to eliminate the necessary turn lane described in my attachment <br /> number one (1) of my last letter. Therefore , the county will need to <br /> decide if the developer will be allowed to regrade SR 1351 in order <br /> to improve the site distance or will you require an additional turn <br /> lane . If the developer is allowed to regrade SR 1351 then he needs <br /> to submit his plans for our review before starting any work. If the <br /> developer decides to build the turn lanes instead then NCDOT will <br /> review his plans as part of his driveway permit. <br /> In order to eliminate any conflict in the time of the developers <br /> plans regrading and NCDOT' s plans to pave SR 1351 , NCDOT will reserve <br /> the right to disapprove the developers regrading plans and require <br /> the turn lane if the developer ' s construction timing interferes with <br /> NCDOT' s paving priority. <br />
