For your information I <br /> have enclosed a copy of a synopsis of the State's Water Supply <br /> Watershed Protection Rules . I believe your own department is in the <br /> process of developing standards which mimmick those of the State. <br /> As you may be aware the Eno river has been classified as WS II (with' <br /> nutrient sensitive waters) . The most recent DEM interpretation of <br /> "critical area" applies only to Class I reservoirs which have an <br /> intake. The Town is still conducting a feasibility study which is <br /> due to be completed late next month. At this point it is anticipated <br /> that for the initial planning period through 2030. that an intake <br /> structure will not be constructed. However , the Town may at some <br /> time need to do so, in which case it would be wise not to preclude <br /> that option. The Town would therefore suggest that the "critical <br /> area" apply to this reservoir when the County adopts zoning for this <br /> area. <br /> I have also enclosed a copy of the proposed reservoir site for your <br /> information. The normal pool and flood ( 1/3 PMP) pool elevations are <br /> currently proposed to be 643 and 648 feet MSL respectively. The Town <br /> will be required to control a fifty (50) foot buffer outside of the <br /> normal pool elevation by easement or ownership.
