the declaration of conciliation failure is served on the <br /> Complainant . <br /> (i) (a) Upon making a declaration of conciliation failure, the <br /> Commission may, in cases arising under Article IV (Fair <br /> Employment) , Article VI (Public Accomodations and Public <br /> Transportation) , and Article VII (Other Prohibited Discriminatory <br /> Acts) , apply to the Director of the Office of Administrative <br /> Hearings, pursuant to N.C .G . S . §7A-758, for the designation of an <br /> administrative law judge to preside at a hearing of the case . <br /> (b) In cases arising under Article V (Fair Housing) in <br /> which the Commission has issued a declaration of conciliation <br /> failure, the Commission must apply to the Director of the Office of <br /> 4 <br /> Administrative Hearings, pursuant to N.C .G . S . §7A-758, for the <br /> 4 designation of an administrative law judge to preside at a hearing <br /> of the case . <br /> (c) In the event the Commission chooses to make application <br /> to the Office of Administrative Hearings , it shall do so within <br /> thirty (30) days of the date it issued its written declaration of <br /> conciliation failure . <br /> (j ) If within 130 days from the date the Complaint was filed, <br /> the Commission has failed to make a determination on the issue of <br /> reasonable cause, the Commission shall, upon written request of the <br /> Complainant , issue a right-to-sue letter to the Complainant . <br /> Sec . 8 . 3 Referral to Office of Administrative Hearings <br /> Subdiv . 8 . 3 . 1 Hearings <br /> (a) Upon receipt of an application for a hearing from the <br /> 44 <br />
