employment _ practice is established when the complaining party <br /> demonstrates that race, color, religion, sex, national origin, age, <br /> disability, marital status , or veteran status was a motivating <br /> factor for any employment practice, even though other factors also <br /> motivated the practice. <br /> (q) On a claim in which an individual proves a violation <br /> under subsection (p) and a respondent demonstrates that the <br /> respondent would have taken the same action in the absence of the <br /> impermissible motivating factor, the court : <br /> (a) may grant declaratory relief, injunctive relief and <br /> attorney' s fees and costs demonstrated to be directly attributable <br /> only to the pursuit of a claim under section (p) ; and <br /> (b) shall not award damages or issue an order requiring any <br /> admission, reinstatement , hiring, promotion, or payment, as <br /> described in Article VIII of this Ordinance . <br /> ARTICLE V Unfair Housing <br /> Sec . 5 . 1 Unlawful Housing Practices, <br /> (a) It is an unlawful discriminatory housing practice for any <br /> person, because of race, color, religion, sex, national origin, <br /> age, disability, marital status, or veteran status to : <br /> (1) Refuse to engage in a real estate transaction; <br /> (2 ) Discriminate against a person in the terms, conditions, <br /> or privileges of a real estate transaction or in the furnishing of <br /> facilities or services in connection therewith; <br /> (3 ) Refuse to permit , at the expense of a qualfied individual <br /> 26 <br />
