2 <br /> Because the bear was not registered as of the fifth of April of 1983, the notice <br /> of violation ordered the wild animal to be removed from orange county on or <br /> before September 4, 1993. Upon verbal notice of Mr. Coleys request to the <br /> Commissioner's for an appeal of this order, the removal deadline has been <br /> extended to September 8, 1993. <br /> The only exemption to the provisions of this ordinance was granted for: <br /> "Animals used for teaching and/or research purposes <br /> at the University of North Carolina at Chapel Hill." <br /> Section 3, Requirements of Permits, continues: <br /> "As a condition precedent to the possession or harboring of any <br /> wild animal, the prospective owner or permittee shall have on the <br /> premises where such animal is kept, sufficient equipment and/or <br /> chemicals necessary to tranquilize or kill any animal for which <br /> the owner or permittee has a permit to keep. <br /> As a further condition, the prospective owner or permittee must <br /> present evidence of training and experience in the care and <br /> handling of wild animals." <br /> Mr. Coley has not presented evidence that he has met either of these two <br /> conditions. Furthermore, prospective owners or permittees must submit an <br /> application for said permit which contains specific information outlined on page <br /> three of the ordinance. <br /> Mr. Coley has stated that his purpose in keeping the animal is to enjoy as a pet <br /> and, "that he had plans to take her to area schools and teach students about <br /> bears." Such a purpose classifies the bear as an exhibition animal which <br /> requires a permit from the North Carolina Wildlife Resources Commission. <br /> Mr. Coley has not obtained such a permit. <br /> The ordinance further requires "proof of applicant's ability to respond in <br /> damages for bodily injury to or death of any person or persons or for damage to <br /> property owned by any other person which may result from the ownership, <br /> keeping or maintenance of such animal." Mr. Coley has not filed with the <br /> Director a Certificate of Insurance, stating that the applicant is insured by a <br /> policy of One hundred thousand dollars ($100,000) combined single limit <br /> liability for bodily injury and property damage. <br /> Appendix A. to the ordinance lists the standards for primary and secondary <br /> enclosures of wild animals. Section d. lists the requirements for bears and <br /> hybrids thereof. Below is an assessment of the requirements and the current <br /> status observed at Mr. Coley's residence. <br />
