131 <br /> DISTRICT [ WATER SUPPLY/SEWAGE DISPOSAL <br /> All Other Repair systems are permitted on a lot other than the lot which is the source of <br /> Watershed wastewater generation provided that the Orange County Health Department <br /> Overlay certifies that: <br /> Districts <br /> 1. The residence or use has a failing system, AND <br /> there is not a suitable location for a repair system on the same lot as the <br /> residence or use; or <br /> 2. In the case of an unimproved lot created by recorded deed, valid probated <br /> will or recorded plat prior to January 1, 1994, there is not a suitable <br /> location for a repair system on the same lot as the residence or use. <br /> 6.23.12 CLUSTERING <br /> DISTRICT CLUSTERING REQUIREMENTS <br /> UNIV-CA Clustering of residential lots is permitted in accordance with Section IV-B-10 of <br /> UNIV-PW the Orange County Subdivision Regulations, with the additional provision that <br /> each lot contains a minimum of one acre. <br /> All Other Clustering of residential lots is permitted in accordance with Section IV-B-10 of <br /> Overlay the Orange County Subdivision Regulations. <br /> Districts <br /> 6.23..13 APPLICABILITY <br /> a) Existing Development <br /> Existing development is not subject to the requirements of this Article. Existing <br /> developments include projects that are built, or at a minimum have established a vested <br /> right under North Carolina zoning law as of January 1, 1994 based on at least one of the <br /> following criteria: <br /> 1. substantial expenditures of resources (time, labor, money) based on a good faith <br /> reliance upon having received a valid local government approval to proceed with <br /> the project; or <br /> 2. having an outstanding valid building permit; or <br /> 3. having expended substantial resources and having an approved site specific or <br /> phased development plan. <br /> 15 <br />
