10 <br /> The proposed road is not designated as an arterial <br /> or collector. <br /> Provided, however, private roads may be allowed in <br /> a subdivision where, in the judgment of the <br /> Planning Board and with the approval of the Board <br /> of County Commissioners, it is found that the <br /> nature and location of the subdivision are such <br /> that a private road is justified. <br /> The proposed road is located in a rural area. <br /> In determining whether to permit private roads in <br /> subdivisions, the following design features will <br /> be considered: <br /> 1. The location and design of the subdivision is <br /> such that it clearly preserves the rural <br /> character of the County through: <br /> a. The provision of lot sizes and building <br /> setback lines greater than required by <br /> ordinance provisions; <br /> Proposed lots range in size from 1 . 7 to 3 . 99 <br /> acres, with an average lot size of 2 .3 acres <br /> [100, 188 square feet] . Individual lot <br /> acreages are all larger than the 40, 000- <br /> square-foot requirement of the AR zoning <br /> district. Two lots have more than four times <br /> the required minimum square footage. Two <br /> lots have more than double the minimum. The <br /> other five have nearly double the minimum. <br /> All setbacks [front, side and rear] are <br /> proposed to be 50 feet. Minimum AR district <br /> requirements are 40 feet on the front and 20 <br /> feet on the sides and rear. <br /> b. The retention and/or provision of <br /> landscaping and use of clustering of <br /> dwelling units to screen the view of the <br /> subdivision from public roads and/or <br /> maintain a wooded or forested character; <br /> About 2/3 of the 20 . 7 acres are heavily <br /> wooded; the remaining 1/3 is open. The <br /> private road justification indicates there <br /> will be minimal destruction of existing <br /> trees . Provisions for tree protection are <br /> proposed for restrictive covenants . <br /> Clustering of dwelling units has not been <br /> proposed. <br /> c. The maintenance of scenic views, <br />
