Title VI - Civil Rights Act of 1991. The Contractor <br /> will comply with all the requirements imposed by Title VI of the Civil <br /> Rights Act of 19.91 (78 Stat. 252) , the Regulations of the U.S. Department of <br /> Transportation issued thereunder (CFR Title 49, Subtitle A, Part 21) , FTA <br /> Circular 1160.1; Interim Guidelines on Title VI - Information Specific to <br /> FTA Programs, and the assurance by the Contractor pursuant thereto. <br /> Section 20. Disadvantaged Business Enterprises. <br /> (a) Policy. It is the policy of the Department that Disadvantaged <br /> Business Enterprises (DBE) as defined in 49 CFR Part 23 shall have the <br /> maximum opportunity to participate in the performance of contracts financed <br /> in whole or in part with Federal funds under the Agreement. Consequently, <br /> the DBE requirements of 49 CFR Part 23 apply to this Agreement. <br /> (b) DBE Obligation. The Contractor or its subcontractor(s) agree(s) <br /> to ensure that Disadvantaged Business Enterprises as defined in 49 CFR Part , <br /> 23 have the maximum opportunity to participate in the performance of <br /> contracts and subcontracts financed in whole or in part with Federal funds <br /> provided under this Agreement. In this regard the Contractor or its <br /> subcontractor(s) shall take all necessary and reasonable steps in accordance <br /> with 49 CFR Part 23 and FTA Circular 4716.1, dated January 15, 1985, and any <br /> subsequent amendments or revisions thereto, to ensure that Disadvantaged <br /> Business Enterprises have the maximum opportunity to compete for and perform <br /> contracts. Contractors and their subcontractor(s) shall not discriminate on <br /> the basis of race, color, national origin, or sex in the award and <br /> performance of Department assisted contracts. <br />
