Article 2 , paragraph 2 . 4 . 3 : The Architect shall advise the Owner <br /> of any adjustments to previous preliminary estimates of <br /> probable Construction Costs indicated by changes in scope of the <br /> work requirements or general market conditions . <br /> Add as Article 2 , paragraph 2 . 4 . 5 : The Architect shall include in <br /> the bidding information, plans or specifications , a requirement <br /> that Prime Contractors provide operation manuals and adequate <br /> training for the experienced staff of the Owner in the <br /> operation of mechanical, electrical, heating and air-conditioning <br /> systems installed by the Prime Contractors . <br /> Add as Article 2 , paragraph 2 . 5 . 2 : In the event the lowest <br /> responsible bids exceed the funds appropriated for the project, <br /> the Architect, in consultation with, and at the direction of, the <br /> Owner, shall provide such modifications in the Contract <br /> Documents and/or negotiations with the low bidder as shall be <br /> necessary to bring the cost of the Project within the Project' s <br /> budget. <br /> Article 2 , paragraph 2 . 6 . 2 : The Architect shall provide <br /> administration of all Prime Contracts for Construction, as set <br /> forth below, and in the 21st Edition of Form OC-15 by the State <br /> Construction Office of the North Carolina Department of <br /> Administration INSTRUCTIONS TO BIDDERS AND GENERAL CONDITIONS OF <br /> THE CONTRACT, dated April 1991 <br /> * The Architect prefers to use this document, as it more <br /> clearly defines the Multiple Prime Contract system than does <br /> the AIA form. <br /> Article 2 , paragraph 2 . 6 . 3 : Construction Phase duties , <br /> responsibility and limitation of authority of the Architect shall <br /> not be restricted , modified or extended without written agreement <br /> of the Owner and Architect and notice to Prime Contractors . <br /> Article 2 , paragraph 2 . 6 . 4 : The Architect shall be the <br /> representative of the Owner during the construction phase of <br /> the contract period, and shall advise and consult with the <br /> Owner . Instructions to the Prime Contractors shall be forwarded <br /> through the Architect. The Architect shall have authority to act <br /> on behalf of the Owner only to the extent provided in this <br /> Agreement, unless otherwise modified by written agreement. <br /> Article 2 , paragraph 2 . 6 . 5 : The Architect shall visit the site <br /> periodically at intervals appropriate to the stage of <br /> construction, or as otherwise agreed by the Owner and the <br /> Architect in writing and shall review the work in progress <br /> during these on-site visits to endeavor to determine for the <br /> Owner's benefit and protection if the work is proceeding in <br /> accordancewith the intent of the Contract Documents and the <br /> construction schedule. The Architect shall be held to the <br /> standard of care (with regard to review by on-site visits) which <br /> is generally accepted in the industry among architects of similar <br /> skill and standing in the community. This duty shall not be <br /> interpreted to mean full-time service, without an amendment to <br /> the contract in writing, specifying this as an additional <br /> -2- <br />
