per month (Conditionally Exempt Small Quantity Generators, CESQGs) to have access to <br />Orange County's Program for fee-based disposal of commercial hazardous waste. <br />In August of 2005, the. BOCC approved an addendum to the original contract allowing for the <br />expansion of program hours from four days per week to six days per week, and also allowing for <br />an additional two year term. <br />Effective July 1, 2006, as part of the BOCC approved FY 2006-2007 budget for the Department <br />of Solid Waste Management, the County began to provide free CESQG collection service to <br />eligible Orange County based businesses and institutions. The Orange County Solid Waste <br />Advisory Board (SWAB) was consulted regarding the proposed policy to begin accepting <br />CESQG wastes and was supportive of including it in the department's proposed FY 2006-2007 <br />budget. The decision to recommend that the County begin to pay to manage CESQG wastes <br />was based on the desire to increase the diversion of the hazardous materials generated by this <br />sector, and was also based on feedback from the business and non-profit communities <br />regarding the fee-based CESQG program and their poor response to and low participation in <br />the fee-based program. Response to the free CESQG service offered since July 1, 2006 has <br />been positive. Through the end of April 2007, 159 CESQG participants have delivered 33,835 <br />pounds of commercial hazardous waste to the CESQG Program. For the full year of FY 2006- <br />2007, it is projected that 195 participants will deliver just over 46,000 pounds of commercial <br />hazardous waste for a projected annual cost of $27,950. This is 14% of the overall program <br />budget that is projected to spend $200,000 this fiscal year. <br />This proposed addendum engages ECOFLO for the two-year extension through June 2009 <br />allowed for in the addendum approved two years ago, and it also clarifies language governing <br />the acceptance of CESQG wastes at no cost to the generator. The proposed addendum further <br />allows the County to negotiate with ECOFLO in order to expand the hazardous waste collection <br />program to include additional collection locations if desired. <br />FINANCIAL IMPACT: The total projected cost of this contract for FY 2007-2008 is $219,600. <br />This amount is included in the proposed Solid Waste Management Departmental Budget. <br />RECOMMENDATION(S): The Manager recommends that the Board approve the Household <br />Hazardous Waste Contract Addendum with ECOFLO Inc. and authorize the Chair to sign the <br />contract addendum, subject to final review. by staff and the County Attorney. <br />
