Petition & SR Addition Investigation <br />Reports for Edburton Court and <br />Berwick Place <br />INFORMATION CONTACT: <br />Karen Lincoln; 245-2594 <br />PURPOSE: To consider a recommendation regarding a request for addition to the State <br />Maintained Secondary Road System for Edburton Court and Berwick Place. <br />BACKGROUND: The property owners on Edburton Court (14 homes) have petitioned the <br />North Carolina Department of Transportation (NCDOT) to accept maintenance responsibilities <br />for Edburton Court and a 0.05-mile portion of Berwick Place. Edburton Court and the 0.05-mile <br />section of Berwick Place are located in Hardscrabble Phase III Section I in Eno Township. <br />Berwick Place crosses the Orange/Durham County line, extending from Hardscrabble Drive in <br />Durham County to provide access to Edburton Court. Hardscrabble Phases I and II are located <br />in Durham County off the north side of St. Mary's Road (SR 1002). <br />The Board of County Commissioners,approved the preliminary plat for Hardscrabble Phase III <br />Section I in November 1994 directing that "Berwick Place and Edburton Court shall be <br />irrevocably dedicated to the general public and be constructed to the standards of the North <br />Carolina Department of Transportation." The approved resolution directed the County Manager <br />to accept "for Orange County and on behalf of the public generally" Berwick Place and Edburton <br />Court without maintenance responsibility, and specified that the "roads shall be maintained by <br />the owner/applicant until such time as they are accepted for maintenance by the NCDOT or <br />some other governmental body." <br />
