Allows for residential lots to be clustered smaller than the 40,000 sq. ft. limit as 1 <br />detailed in Section 7.13.4 (B) (6) of the UDO with the preservation of additional common 2 <br />open space area(s) within the subdivision. 3 <br /> 4 <br />iii. Allows for a maximum of 12 lots (vs. the current maximum of 5 lots with a 5 <br />conventional design) to be allowed through the Minor Subdivision process if the property 6 <br />owner/applicant chooses to go through the Flexible Design subdivision process. 7 <br /> 8 <br />iv. Maintains current density limits, but allows for added lots via more flexible design 9 <br />requirements. 10 <br /> 11 <br />v. Mimics Flexible Designed provisions already permitted with Major Subdivisions within 12 <br />County. 13 <br /> 14 <br />vi. Allows development to cluster in logical land use patterns that complement the 15 <br />transition from urban to rural areas of the County. 16 <br /> 17 <br />The goal is to revise existing development standards in an effort to encourage purposeful 18 <br />growth and development within the County in a cost efficient manner (e.g. shorted roads and 19 <br />area cleared for residential lots), while promoting the perpetual maintenance/preservation of 20 <br />common open space areas. 21 <br /> 22 <br />Planning Director’s Recommendation: The Planning Director recommends approval of the 23 <br />Statement of Consistency, indicating the amendments are reasonable and in the public interest, 24 <br />contained in Attachment 2 and proposed UDO text amendment package contained in 25 <br />Attachment 3. 26 <br />Planning Board Recommendation: The text amendment was presented to the Planning Board’s 27 <br />Ordinance Review Committee (ORC) on September 7, 2016. Planning and Environmental 28 <br />Health Staff presented materials related to conservation, open space, flexible design, and the 29 <br />state’s new guidelines for off-site individual septic systems. This item was then presented to the 30 <br />Planning Board at its October 17, 2016 meeting. The Planning Board voted unanimously to 31 <br />recommend approval of the Statement of Consistency contained in Attachment 2 and the UDO 32 <br />text amendment package contained in Attachment 3. 33 <br /> 34 <br />BOCC Quarterly Public Hearing 35 <br />UDO Text Amendment 36 <br />of Minor Subdivision Regulations – Item D.2 37 <br />November 21, 2016 38 <br /> 39 <br />Goal of the Amendment 40 <br />• As directed by the BOCC on February 18, 2016, Planning staff is proposing 41 <br />amendments to the UDO, providing additional opportunities for the clustering of 42 <br />subdivision lots and the preservation of open space. 43 <br />• The proposed amendments align with Housing and Land Use Goals in the 44 <br />Comprehensive Plan. 45 <br />• This amendment addresses a petition by the Commissioners to encourage the clustering 46 <br />of residential lots and preserve open space. 47 <br /> 48 <br />Objectives 49 <br />1.
