11 <br /> 1 • The Ordinance Review Committee reviewed the proposed text amendment, <br /> 2 heard a presentation from Environmental Health on off-site septic systems, and <br /> 3 provided feedback to Planning staff at the ORC meeting on September 7, 2016. <br /> 4 STEP THREE — Planning Board Meeting <br /> 5 • The Planning Board reviewed the proposed text amendment and made a <br /> 6 recommendation to the BOCC in compliance with Section 2.8.8. <br /> 7 • The Planning Board voted unanimously to recommend approval of the text <br /> 8 amendment. <br /> 9 STEP FOUR—Quarterly Public Hearing <br /> 10 • After considering these recommendations, the BOCC will deliberate, certify the <br /> 11 record, close the public hearing, and render a final decision. <br /> 12 <br /> 13 Recommendations <br /> 14 1. Receive the proposed amendments. <br /> 15 2. Conduct the public hearing and accept comment on the proposed amendments. <br /> 16 3. Close the public hearing. (Note that, because this is a legislative decision, additional <br /> 17 comments at a later date are permitted). <br /> 18 4. Decide on one of the following options: <br /> 19 a. Adopt the proposed amendments by approving the Statement of Consistency <br /> 20 (Attachment 2) and Ordinance (Attachment 3); <br /> 21 b. Defer a decision to a later BOCC regular meeting date; <br /> 22 c. Refer the item back to the Planning Board for a specific purpose; or <br /> 23 d. Deny the proposed amendments. (Note: Section 2.2.8 Effect of Denial on <br /> 24 Subsequent Applications of the UDO states that no application for the same or <br /> 25 similar amendment may be submitted for a period of one year. The one-year <br /> 26 period begins on the date of denial.) <br /> 27 <br /> 28 Commissioner Dorosin referred to the 5-12 minor subdivision, and clarified that a minor <br /> 29 subdivision can go up to 12 lots, if it clusters the lot and has open space, and if there is an entity <br /> 30 to manage that open space. <br /> 31 Patrick Mallett said yes. He said above the cap, there must be a proportional amount of <br /> 32 open space. <br /> 33 Commissioner Dorosin said it is not an increase of density, because most of these could <br /> 34 accomplish that density, but choose not to because of not wanting to fall into the major <br /> 35 subdivision category. <br /> 36 Patrick Mallett said yes. <br /> 37 Commissioner Dorosin said this is exciting. <br /> 38 Commissioner Rich agreed that she liked this proposal. She referred to page 1-63, and <br /> 39 asked if there is a reason that developers are only being encouraged to support connectivity, <br /> 40 and not strongly encouraged. <br /> 41 Patrick Mallett said the reality is that with subdivisions you look at the big picture and try <br /> 42 to look for opportunities for connectivity. <br /> 43 James Bryan said staff has to go by the ordinance, and the ordinance has to have very <br /> 44 clear standards. He said the Board of County Commissioners has discretion over projects but <br /> 45 staff does not, thus the word "encourage". <br /> 46 Commissioner Rich brought up her neighborhood, saying it flows nicely with the open <br /> 47 spaces. She said she hoped, when applicable, that all would encourage connectivity with open <br /> 48 spaces. <br /> 49 Patrick Mallett said this is in the context of a minor subdivision only, which can go up to a <br /> 50 maximum of 12 lots. <br />
