He said staff's recommendation is due to the <br /> 2 property's location in a commercial industrial transition zone, and this is a more acceptable land <br /> 3 use for the area in general versus existing industrial. <br /> 4 Commissioner Jacobs asked if this is part of the Efland Mebane Small Area Plan. <br /> 5 Michael Harvey said yes. <br /> 6 Commissioner Jacobs said the purpose, in part, for that Plan was to pre-plan for some <br /> 7 commercial development on this corridor, where there was existing infrastructure. <br /> 8 Michael Harvey said staff believes general commercial zoning allows for more flexibility. <br /> 9 Michael Harvey referred to the parcel of land off of Mt. Willing Road, saying it is zoned <br /> 10 commercial property, and staff is recommending it be re-zoned agricultural residential. He said <br /> 11 the Department of Transportation (DOT) owns this parcel. He said there may have been a <br /> 12 commercial entity at some point, but when DOT took the property the zoning was not re- <br /> 13 designated. <br /> 14 Michael Harvey referred to the next parcel, which is an existing automotive repair <br /> 15 business, off of highway 70. He said the majority of the property is zoned neighborhood- <br /> 16 commercial. He said staff is recommending that the entire parcel be zone neighborhood- <br /> 17 commercial. He said this property will also have to insure that the land use buffer is part of the <br /> 18 commercial lot. <br /> 19 Michael Harvey reviewed the remaining parcels of land, their zoning designations, and <br /> 20 any changes being proposed by staff. <br /> 21 Commissioner Dorosin asked if the process by which staff identified these parcels could <br /> 22 be explained, and if there are other parcels that may be brought forward in the future. <br /> 23 Michael Harvey said Attachment 3 shows that staff identified approximately 100 <br /> 24 properties in the Bingham, Cheeks and Cedar Grove Townships, which had inconsistent or <br /> 25 messy zoning. He said the property owners were contacted to discuss the land, some of whom <br /> 26 expressed no interest in changing the zoning of their land. He said this is acceptable as long as <br /> 27 there is no inconsistency with the comprehensive plan. He said the other four townships will be <br /> 28 reviewed at a later date. <br /> 29 Commissioner Jacobs said this is all consistent with the Woods rezoning on Highway 70, <br /> 30 when the Board of County Commissioners asked staff to fix all of these properties. He said that <br /> 31 brought the need for rezoning to the County's attention years ago. <br /> 32 Michael Harvey said this project has been a long time coming and is not yet completed. <br /> 33 He said it has been important to involve the landowners in the discussion. <br /> 34 Commissioner Price agreed that this is excellent work. <br /> 35 Commissioner Price referred to the parcels with owners who do not want rezoning, and <br /> 36 asked if these properties were to be sold in the future, would the new owner be made aware of <br /> 37 the zoning inconsistencies. <br /> 38 Michael Harvey said anyone that buys property should ask about zoning, but staff will <br /> 39 work with anyone to insure the zoning is consistent. He said staff was given a specific direction <br /> 40 to look at zoning by the Board of County Commissioners, and if the residents choose not to take <br /> 41 advantage of this opportunity then the onus would be on the residents. <br /> 42 Chair McKee asked if any property owners, or other members of the public, would like to <br /> 43 speak. <br /> 44 <br /> 45 PUBLIC COMMENT: <br /> 46 Rob Gray said it would be helpful to display the Ashwick neighborhood across from <br /> 47 Highway 70. <br /> 48 Michael Harvey said he did not have that map. <br /> 49 Rob Gray asked for a map of the property across from this location, where there is a golf <br /> 50 cart repair business.
