187 <br /> mind are existing churches, community centers or <br /> neighborhood convenience stores wanting to expand <br /> but lacking sufficient area to satisfy impervious <br /> surface standards. <br /> The proposed amendment would permit a land owner to <br /> satisfy the impervious surface limitations in <br /> protected watersheds through approval and <br /> recordation of a conservation agreement. The <br /> agreement between Orange County and a land owner <br /> would prohibit development of land in a protected <br /> watershed in perpetuity. In such cases, a <br /> modification of the required impervious surface <br /> ratios could be approved administratively but only <br /> to the extent that additional land in the same <br /> watershed is conserved or protected from <br /> development. Furthermore, the land which would be <br /> subject to a conservation agreement must be adjacent <br /> to the land proposed for development and for which a <br /> modification of the impervious surface ratios is <br /> sought. <br /> RECOMMENDATION: Article 20 .3 of the Zoning Ordinance requires that <br /> the Zoning Officer's recommendation be presented to <br /> the Planning Board within 30 days of receipt of an <br /> application. However, Article 20.4 exempts any <br /> application for amendment to the Zoning Ordinance <br /> text by either the public or the County from the <br /> provisions of Article 20.3. In either case, though, <br /> the public hearing is the time scheduled for <br /> presentation of the Zoning Officer's <br /> recommendation. <br /> Zoning Officer Recommendation <br /> The Zoning Officer prepared the proposed Zoning <br /> Ordinance text amendment. Provided the Planning <br /> Board and Board of Commissioners find in the <br /> affirmative, the Zoning Officer recommends approval <br /> of the proposed text amendment. <br /> No decision is made on the proposed amendment by <br /> either the Planning Board or Board of Commissioners <br /> at the public hearing. Amendments initiated by the <br /> County are not subject to time limitations other <br /> than those specified by the Board of Commissioners. <br /> Administration Recommendation <br /> The Administration recommends that the proposed <br /> amendment be referred to the Planning Board for a <br /> recommendation to be returned to the Board of <br /> Commissioners no sooner than August 2, 1993. <br />
