The new subsection will permit the use of land subject <br /> to a conservation easement in the calculation of impervious <br /> surface limitations . As a threshold matter, there is a policy <br /> issue which should be highlighted in the abstract and identified <br /> in the staff presentation during the public hearing. That issue <br /> is : Should Orange County take title to conservation easements to <br /> enable the further development of private land? You and I <br /> haven't discussed this issue because it hadn't occurred to me <br /> that the conservation agreements would involve the County. <br /> Rather, I envisioned the agreement to be between two private land <br /> owners . As a practical matter, however, the agreements must <br /> involve the County because of the limitations contained in the <br /> relevant enabling legislation. <br /> With respect to the ordinance amendment itself, the examplf <br /> contained in the second paragraph of paragraph b. needs to be <br /> revised. A person planning 5500 square feet of impervious <br /> surface on a 40, 000 square foot lot will need a conservation <br /> agreement covering 5833 square feet of land rather than 700 <br /> square feet.
