Orange County SE & SC Ordinance S pte mbef '�, 2- 0(gSepternber 12, 20h6 <br />SECTION 24 RESTORATION OF AREAS AFFECTED BY FAILURE TO <br />COMPLY <br />The County may require a person who is engaged in a land- disturbing activity and failed <br />to retain sediment generated by the activity, as required by G. S. 1 l3A- 57(3), to restore the <br />waters and land affected by the failure so as to minimize the detrimental effects of the <br />resulting pollution by sedimentation. This authority is in addition to any other civil or <br />criminal penalty or injunctive relief authorized under this Ordinance. <br />SECTION 25 SEVERABILITY <br />If any one or more sections or portions thereof of this Ordinance are held to be invalid or <br />unenforceable, all other sections and portions thereof shall nevertheless continue in full <br />force and effect. <br />SECTION 26 EFFECTIVE DATE <br />This Ordinance will become effective upon passage by the Orange County Board of <br />Commissioners and the approval of the North Carolina Sedimentation Control <br />Commission. <br />Explanatory Note: The Soil Erosion and Sedimentation Control Ordinance was originally <br />adopted by the Orange County Board of Commissioners on December 30, 1975 and <br />amended on the dates listed at the end of this Ordinance. <br />SECTION 27 REVISIONS TO THIS ORDINANCE <br />The County shall review all the Commission's revisions to the Model Ordinance and, <br />within 90 days of receipt of the recommended revisions, submit draft amendments to the <br />Commission for its consideration and comments. Within 150 days after receipt of the <br />Commission's comments, the County will formally consider proposed amendments and to <br />the extent deemed necessary by the County, incorporate the amendments into the Erosion <br />Control Ordinance. <br />37 <br />
