Allow for the imposition of reasonable conditions to minimize off -site impacts and to <br />assure the compatibility of proposed land uses with surrounding properties, <br />4. Require a higher level of amenities that are appropriate and harmonious with the area, <br />Encourage a variety of initiatives designed to encourage developments to incorporate <br />appropriate smart - growth principles within the physical development and design of a <br />proposed development to secure an improved living and working environment. <br />Any use permitted under this CU approval process must also conform to the development <br />regulations for the corresponding general zoning district as well as any specific development <br />principle outlined within this Section or required by the Board of County Commissioners. This <br />is a voluntary procedure that is intended for firm development proposals. It is not intended or <br />suited for securing early zoning for tentative proposals that may not be undertaken for some <br />time. <br />Following Board of County Commissioners approval, the property so zoned will be identified on <br />the zoning maps by the appropriate parallel CU designation. This designation is the general <br />zoning district designation plus the letters "CU ". <br />Section 4. Create a new Section 8.9 SPECIAL AND CONDITIONAL USES as follows: <br />Section 8.9.1 Types of Conditional Use Districts: For the purposes of this section, there are <br />two (2) categories of CU as outlined within Article 4. Establishment of Permitted Use Table and <br />Schedule: <br />1. Agricultural Services (AS) District, and <br />2. Rural Economic Development Area (REDA) District. <br />Section 8.9.2 Application Process <br />Rezoning petitions to establish a CU shall be submitted to the Zoning Officer and will be <br />processed according to the procedure for zoning amendments described in Article 2 of the <br />Zoning Ordinance, as well as the provisions of this Section. A CU classification will only be <br />considered if the owner of the property, or his/her authorized agent, makes the application. All <br />applications shall be completed on forms provided by the Orange County Planning Department <br />Submittal Requirements. In conjunction with a rezoning petition, an applicant shall also be <br />required to complete and submit an application for development plan approval. A development <br />plan is submitted so that property owners or their agents may provide more information than <br />would be found with a normal rezoning petition.. The development plan is voluntarily provided <br />to ensure: <br />1. Compatibility with adjacent uses, existing development, and development patterns, <br />2. Compatibility with the natural resources or environmentally sensitive areas, <br />3. Existing infrastructure will not be overburdened, <br />4. Compatibility with the rural nature of the community <br />
