NC Highway 57 Speedway Area Small Area Plan <br />DEW V <br />• <br />PROPOSED ORDINANCE TO JOINT QUARTERLY PUBLIC HEARING <br />August 27, 2007 <br />An Ordinance Amending <br />The Orange County Zoning Ordinance <br />Be it ordained by the Board of Commissioners of the County of Orange, North Carolina, that the <br />Orange County Subdivision Regulations are hereby amended as follows: <br />Section 1. Add a definition to ARTICLE 22 DEFINITIONS regarding Rural Economic <br />Development as follows: Rural Economic Development Area is a zoning district created to allow <br />additional non - residential development within rural areas of the County, specified in the <br />Comprehensive Plan, on property that has been identified as being potentially suitable for non- <br />residential development. The zoning district shall be designated first with the under -lying base <br />zoning (i.e., AR) and then with a REDA to designate that a site - specific conditional use <br />development plan is part of the rezoning approval. <br />Section 2. Add a definition to ARTICLE 22 DEFINITIONS regarding Rural Economic <br />Development as follows: Development plan is a type of plan that becomes part of a conditional <br />use approval made part of REDA rezoning approval and provides guidance for the preparation of <br />a site plan. <br />Section 3. Add a new Section 4.2.26 to ARTICLE 4. ESTABLISHMENT OF PERMITTED <br />USE TABLE AND SCHEDULE to create a new Conditional Use District as follows: <br />Section 4.2.26 Conditional Use District. This ordinance contains regulations that establish <br />zoning districts and assign land uses to one or more of these districts. The ordinance also <br />provides standards for development that regulate lot size, yards, parking and open space. <br />There are certain circumstances that arise when a general zoning district designation would not <br />be appropriate for a certain property, but a conditional use permitted under the district would be <br />consistent with the objectives of this ordinance. In areas where the Board of County <br />Commissioners has approved a small area plan there may be opportunities to allow for specific <br />classifications of non - residential development within the small area plan not normally permitted <br />with the underlying zoning district. <br />To accommodate these situations, this Section establishes the Conditional Use (CU) approval <br />process. The CU approval process addresses those situations involving a rezoning when a <br />particular use may be acceptable for a given area but the general classification that would allow a <br />specific use would not be acceptable. This process allows the Board of County Commissioners <br />to: <br />1. Approve a rezoning proposal for a specific, defined use, <br />2. Promote economical and efficient land uses within the rural areas of the County, <br />45 <br />
