NC Highway 57 Speedway Area Small Area Plan <br />premises. All equipment operating on the property are equipped with back up alarm <br />systems, or other similar equivalent, and a water wagon, or other similar apparatus, shall <br />be used as needed to manage dust flow throughout the property. <br />The property owner shall make an annual report available to the BOCC detailing material <br />extracted, area of extraction, extraction depth, and ground water testing results, and shall <br />demonstrate to the County Zoning Enforcement Officer that all operations on the quarry <br />property conform to all previously approved mining permits, reclamation plans, and used <br />only for mining, processing, storage, and sale of stone. <br />6. End of Operations Plan. The property owner shall notify Orange County one (1) year <br />notice in advance to cessation of operations at the quarry property and shall post a <br />rehabilitation bond with the Orange County at this notification date. The bond shall only <br />be released after operations cease and the County- approved rehabilitation plan. The <br />approved reclamation plan shall be made a part of the permit and the quarry reservoir <br />shall be used for raw water storage. At the end of quarry operations, the stone quarry <br />managers shall initiate or otherwise be a party to the completion of the end use plan. <br />7. The quarry operation shall meet all applicable requirements of a Zero Discharge <br />Facility as defined by the State of North Carolina. <br />8. There shall be no storage or use of hazardous materials on the property, with the <br />exception of motor vehicle fuels. <br />9. Lighting shall be installed and operated according to the Orange County lighting <br />standards. <br />10. The existing property lines may expand beyond the present boundaries, but only to <br />enhance the 200 foot perimeter buffer, not to expand quarry operations. <br />11. Any significant change to the approved site plan shall require an amendment to the <br />Special Use Permit according to Section 8.7 of the Zoning Ordinance. <br />Objective 7 -3. At the time of end of quarry operations, Orange and Durham Counties <br />shall enter into a joint development agree to acquire, design, program, develop and <br />finance a recreational facility on the stone quarry leased and fee simple properties. <br />Policy. The BOCC shall continue to find appropriate recreational sites for use by local <br />residents and shall continue to monitor the quarry operation to determine the appropriate <br />time for development of identified recreational amenities on the site as delineated within <br />their final action plan on file with the State of North Carolina. <br />The Task Force finds that specific conditions ought to be adhered to by the existing non- <br />residential land uses to address off -site impacts and that these conditions ought to be part of the <br />review and approval process of any change to the zoning classification of these properties. <br />Goal 8. Each existing non - residential land use should be held to specific development/re- <br />development criteria if they choose to take advantage of the sanctioned approval process for <br />becoming conforming land uses. <br />32 <br />
