When the right-of-way is <br /> abandoned, ownership would revert to adjacent property <br /> owners, in this case, the owners of lots 9 and 10 in <br /> Birchwood Lake Estates, Phase I . These owners have <br /> agreed in writing that the land in the stubout will be <br /> deeded to Mr. John Glenn Whitfield and may be used <br /> for a driveway for one lot. <br /> The Planning Board will review the Preliminary Plan <br /> for Whitfield's Glen on March 15th. Its recommenda- <br /> tion will be reported at the Commissioners meeting. <br /> The attached resolution is to set a public hearing for <br /> the Board of Commissioners' second regular meeting in <br /> April. This date will allow time for the resolution to <br /> be advertised for four successive weeks prior to the <br /> hearing as required by State law. <br /> RECOMMENDATION: The Administration recommends adoption of the <br /> resolution setting public hearing for April 20, 1993 . <br />
