Review and Approval Process <br /> There were several questions and general discussion about the proposed approval <br /> process and how is differs from that in place now. <br /> Even though the uses proposed for the ED district could be allowed under current <br /> regulations upon approval of a rezoning, the rezoning/public hearing process <br /> offers area residents a greater sense of protection. <br /> What if the staff claims that the design guidelines are not met and the applicant <br /> disagrees? Is there an appeal? (There is no "appeal". The applicant would <br /> submit a Special Use Permit in accordance with the same rezoning procedure that <br /> is in effect now.) <br /> How soon will the proposal be approved? <br /> What process would be required if new public roads were built? <br /> There should be a way for property owners to be notified of development plans, <br /> even if a public hearing is not held. <br /> Wording in the Performance Standards "encourages" particular uses, site <br /> amenities, building materials, etc; specific requirements should be required or <br /> prohibited -- wording should be stronger. <br /> 8. Current Review and Approval Process <br /> Establishment and expansion use lower intensity uses can be done now with a <br /> Land Use Plan Amendment and a re-zoning -- the process should remain this <br /> way. <br /> - For all intents, it is impossible to expand a use such as PHE within the node as <br /> it exists; it is very unlikely that a LUP amendment and re-zoning would be <br /> approved, or that a company interested in the location would be willing to put this <br /> level of effort into the area with such limited chances of success. Other <br /> - Discussion of Durham outer loop proposals. <br /> - Does anyone involved with this proposal actually live in the proposed district? <br /> Will impact fees be charged to provide for road improvements which may be <br /> needed to accommodate additional traffic on NC 86 and other roads? <br /> It would be better to let some of the Rural Buffer develop so that all of the <br /> growth and impact is not concentrated in one area. <br />
