5 4--2- 3 <br /> Finding of Categorical Exclusion <br /> Project Name: Orange County HOME Consortium/Housing Rehabilitation Program <br /> Location: Towns of Carrboro, Chapel Hill, Hillsborough and Orange County <br /> Project Description: Single Family, Scattered Site Housing Rehabilitation <br /> Program <br /> Statement: This project has been determined to be categorically Excluded from <br /> National Environmental Protection Act (NEPA) Requirements under 24 <br /> CFR 58.35 as follows (Check one of the following): <br /> (1) Acquisition, construction, reconstruction, rehabilitation, <br /> or installation of public facilities and improvements eligible under 24 <br /> CFR 570.201(c) and 571 .201(c) including these activities carried out as <br /> part of an economic development project in conjunction with the special <br /> economic development activities eligible under 24 CFR 570.203. Such <br /> activities are categorically excluded from the NEPA requirements only in <br /> the following circumstances. <br /> (i) The facilities and improvements acquired for continued use, <br /> are in place and will be retained in the same use <br /> that existed at the time of acquisition, without <br /> change in size, capacity or character. <br /> (ii) The facilities or improvements replace or upgrade existing <br /> facilities or improvements with only a minimal change in use, <br /> size, capacity, or location (e.g. , replacement of railroad <br /> spurs, water or sewer lines, reconstruction of curbs and <br /> sidewalks, repaving streets). <br /> (iii) The facilities and improvements are consistent with the <br /> use of that site and the action will not change the use, size, <br /> capacity, or character of the site (e.g. , landscaping, street <br /> furniture, play equipment for established parks and <br /> playgrounds). <br /> (2) Special projects directed to the removal of material and <br /> architectural barriers that restrict the mobility and accessibility of <br /> elderly and handicapped persons as authorized by Section 105(a)(5) <br /> of Title I and 24 CFR 570.201(k). <br /> • <br /> 12 <br />
