f `-/ 93 <br /> 6 <br /> HI. REQUIREMENTS FOR CERTIFICATION <br /> A. ELIGIBILITY <br /> Any local government which meets the criteria set forth <br /> in this document is eligible to apply for certification. <br /> The National Historic Preservation Amendments Act of 1980 <br /> contains five broad standards which must be met by a <br /> local government seeking certification. The local <br /> government must: <br /> * Enforce appropriate state or local legislation for <br /> the designation and protection of historic <br /> properties. <br /> * Establish by local legislation an adequate and <br /> qualified historic preservation review commission. <br /> * Maintain a system for the survey and inventory of <br /> historic properties. <br /> * Provide for adequate public participation in the <br /> local historic preservation program, including the 1 <br /> process of recommending properties to the NRHP. <br /> * Satisfactorily perform the responsibilities <br /> delegated to it under the Act. <br /> In addition to the federal criteria listed above each <br /> state may specify additional requirements. The minimum <br /> requirements for certification of local governments in <br /> North Carolina are outlined below. <br /> B. LOCAL LEGISLATION <br /> 1. The purpose of the historic preservation law shall <br /> be clearly stated and should be substantially <br /> similar to the language of the purpose clauses in <br /> the North Carolina enabling legislation for historic <br /> preservation commissions (North Carolina G.S. 160A- <br /> 400. 1 through 160A-400. 14) . <br /> 2 . The law shall clearly define a process and criteria <br /> for historic district and/or historic landmark <br /> designation. (G.S. 160A-400.4, 160A-400.5 and <br /> 400. 6) . <br /> 3 . The law shall establish a commission which shall <br /> have the authority to review and render a binding <br /> decision upon all proposed alterations, relocations, <br /> demolition and new construction within the <br />
