jurisdiction over the dispute;or the attorney seeking the PHI has requested a qualified <br /> protective order from such court or administrative tribunal. A"qualified protective <br /> order"is an order of a court or of an administrative tribunal or a stipulation by the <br /> parties to the litigation or administrative proceeding that:(i)prohibits the parties from <br /> using or disclosing the PHI for any purpose other than the litigation or proceeding for <br /> which such information was requested;and(ii)requires the return of the PHI or <br /> destruction of the PHI(including all copies made)at the end of the litigation or <br /> proceeding. Documentation may include,for example,a copy of the qualified <br /> protective order that the parties have agreed to and documentation or a statement <br /> that the order was presented to the court,or a copy of the motion to the court <br /> requesting a qualified protective order. <br /> Step 3: <br /> The HIPAA Compliance Officer shall ONLY disclose the PHI that has been requested in the subpoena. The HIPAA Compliance Officer shall also contact the issuer of the request <br /> whenever it is unclear what PHI North State Medical Transport is required to disclose. If necessary,the HIPAA Compliance Officer shall ask the requesting agency to re-issue a <br /> more specific request. The HIPAA Compliance Officer shall retain a copy of the request from the attorney as well as the satisfactory written assurances in the patient file.
