Policy 17: Staff Member Action Plan for Release of PHI to Law Enforcement Without Legal Process <br /> North State Medical Transport Staff Member Action Plan: <br /> Release of PHI to Law Enforcement Without Legal Process <br /> Step 1: If the request comes from law enforcement,verify the identity of the law enforcement official and ask the official what is the purpose for which the request is being <br /> made. <br /> Step 2: Is the law enforcement officer requesting N4 YES <br /> information for one of the law enforcement purposes listed <br /> in this action plan? Go to Step-A You may release the PHI in accordance with the corresponding guidance for each purpose,listed in <br /> the column directly across from the stated purpose. Formal written patient authorization is not <br /> required when releasing PHI pursuant to one of the purposes listed in this policy. But;if the <br /> patient is readily available and able to consent to the disclosure,verbal consent should be <br /> obtained and documented before disclosure of PHI is made to the law enforcement official. In <br /> addition,you should record,at a minimum,the following information about all law enforcement <br /> requests that are unaccompanied by legal process: <br /> • The name of the law enforcement official; <br /> • The date and time of the request; <br /> • The purposes for which the request was made(if provided); <br /> • What information the law enforcement official requested; <br /> • Whether the patient was consulted about the request and the patient's response; <br /> • Whether the HIPAA Compliance Officer or other individual at North State Medical <br /> Transport was consulted about the request; <br /> • Whether the law enforcement official made_ any representations to North State <br /> Medical Transport; <br /> • Whether PHI was released and what PHI was released;and <br /> • The reason(s)why the PHI was released. <br /> Required by State Reporting Law Required by State Reporting Law <br /> The information that the law enforcement officer is asking You may release any PHI that is necessary to comply with state reporting law and should track the disclosure on a <br />
