h. Whether PHI was released and what PHI was released; and <br /> i. The reason(s) why the PHI was released. <br /> Purposes for Which Disclosure Can Be Made to Law Enforcement Without Legal Process <br /> Disclosures of PHI Required by State Reporting Law <br /> 1. North Carolina law requires that North State Medical Transport staff members report <br /> the following types of incidents to law enforcement agencies in North Carolina: <br /> [N/A.] <br /> 2. If there is any doubt regarding whether or not North Carolina requires reporting of a <br /> particular injury or incident,the staff member should contact a supervisor for a list of <br /> incidents that must reported under North Carolina law. <br /> Disclosures of PHI to Locate or Identify a Suspect, Material Witness, Fugitive or Missing <br /> Person <br /> 1. PHI may be disclosed to law enforcement for purpose of locating or identifying a <br /> suspect, material witness,fugitive or missing person only upon request of a law <br /> enforcement official. The disclosure may not be initiated by North State Medical <br /> Transport. <br /> 2. If a law enforcement official indicates to a staff member that they need PHI about an <br /> individual to identify or locate a suspect, material witness,fugitive or missing person, <br /> the staff member should ask the law enforcement official to confirm that the sole <br /> purpose of the request is to locate or identify one of the listed individuals. If the law <br /> enforcement official already knows who the individual is and where the individual is <br /> located, then the staff member should not proceed to disclose PHI for this purpose. <br /> 3. Although no formal written request is required from law enforcement, the staff member <br /> should ask that the PHI request be documented in writing, preferably on the law <br /> enforcement department's letterhead. In the absence of a written request from the law <br /> enforcement agency, the staff member should, at a minimum, document that the law <br /> enforcement officer verified that the PHI was needed to identify or locate a suspect, <br /> material witness,fugitive or missing person. <br /> 4. If the staff member is satisfied that law enforcement has made a good faith <br /> representation that the information requested is needed to locate or identify a suspect, <br /> fugitive,material witness, or missing person,then the staff member may disclose only <br /> the following PHI about that individual to the official: <br />
