In fact, title to all real <br /> property purchased for use by an area mental health authority must be <br /> held by the county where the property is located. G.S. Section 122- <br /> 35.53 (effective July 1, 1981). A mental health authority has power to <br /> lease real property, own and lease personal property all in accordance <br /> with rules and regulations of the Department of Human Resources. <br /> G.S. Section 122-35.53(d), (e), (1) and (g). Beyond these powers, the - <br /> area authorities have only the power to contract for the provision of <br /> authority services (including some powers incident thereto). G.S. <br /> Section 122-35.49. <br /> It is therefore my conclusion that the power to contract for <br /> the renovations of the building owned by Orange County on the <br /> Northside property which will be used for the "Willie M" program lies <br /> with Orange County. The construction contract should also be "let" by <br /> Orange County. The plans and specifications should, of course, be <br /> approved by OPC Mental Health. OPC can perform the day-to-day <br /> administration of construction to the extent you wish. It is <br /> appropriate for OPC Mental Health to lease the space it now occupies <br /> from Orange County and to lease the space it will use for the Willie <br /> M program from Orange County. <br /> Very truly yours, <br /> 4 <br /> eo fre E.
