C t S"2----- <br /> TO: The Honorable Board of County Commissioners, <br /> Orange County, North Carolina <br /> COMMISSIONERS: <br /> That if the Land Use Plan for Orange County is modified or changed in <br /> Chapel Hill Township from Rural Residential to a Twenty Year Transition Area <br /> and the area be classified a Commercial Transition Activity Node, which is to <br /> be called the Murphy School Commercial Transition Activity Node as requested, <br /> this property being within the area described and set forth in Exhibit A hereto <br /> attached, then we, the following property owners, request the Board of County <br /> Commissioners to rezone our respective properties, now classified as Rural <br /> Residential to Community Commercial Three Zone. <br /> That the reasons we make this request are as follows: <br /> 1. That the area involved is obviously not of a rural residential <br /> character. <br /> 2. That there are already existing in this area some eight or nine <br /> commercial operations; Dean's Truck & Coach, G & M Electric, Phillips General <br /> Repair, Bass' Welding Shop, Corner Grocery, Starcastle Disco, Orange Glass <br /> Company, Piedmont Paving Company, and Automotive Catering Service. That many <br /> of these commercial ventures have been in operation for as much as ten years <br /> or more at their present locations. <br /> 3. That this property is located near 1-85 and the Southern Railroad. <br /> 4. That there is no possible harm or danger to the public from this <br /> rezoning, <br /> That a legal description of the land involved is hereto attached and <br /> marked Exhibit 1. That other maps will be furnished as requested. <br /> There is no alleged error in the Ordinance that would be corrected by <br /> this proposed Amendment. <br /> That further there has been, over the years, a change of condition is th's <br /> neighborhood toward commercial ventures and that this rezoning would and is <br /> reasonably necessary to the protection of the public health, safety, and genera' <br /> welfare, That this zoning change would in no way be injurious to the public <br /> health, safety, and general welfare. <br /> That this proposed zoning request historically yhwill was originally carry <br /> ryio i <br /> and purpose of the zoning ordinance and zoning atlas <br /> on February 6, 1967. That the properties in question have historically be <br /> zoned residential.
