00744 <br /> 4-, <br /> The Planning Staff finds that there is a perponderence of evidence to <br /> indicate substantial compliance with the General Standards and specific <br /> rules governing the request by Buck Mbuntain Development Co. for a Class <br /> A Special Use Permit under Section 8.8.8 of the Orange County Zoning Ord- <br /> inance. The planning Staff reconuends approval of the Special Use Permit <br /> with the following imposed conditions: <br /> 1. That the final site plan and narrative of the project <br /> incorporating all changes, deletions and additions <br /> through the final approval of the project are inc- <br /> orporated herein and made a part of the Special Use <br /> Permit. That a copy of the final site plan and <br /> narrative be on file with the Orante County Planning <br /> Department. All improvements as indicated on the <br /> site plan or stated in the narrative shall be const- <br /> ructed according to the construction schedule: set <br /> up on the final site plan. <br /> 2. That the grantee of this Spacial Use Permit shall <br /> post with Orange County, in a form acceptable to <br /> the County Attorney, a bond or letter of credit in <br /> an amount equal to the cost of all improvements plus <br /> 10%. The amount shall be determined on the basis of <br /> fully executed construction contracts or certification <br /> by a registered engineer employed by the grantee of <br /> this Special Use Permit. Security for construction <br /> of the improvements in this project may follow the <br /> phasing in the project. Specifically, as improve- <br /> ments are completed in each phase, that phase and <br /> a corresponding amount of money may be released <br /> from the security instruments or the security ins- <br /> truments may be renegoitiated based on the uncon- <br /> struted portion of the improvements. <br /> 3. That security shall be provided for the grading, <br /> paving and stabilization of all cleared areas, <br /> streets and other vehicular travel ways; parking <br /> areas; erection of street signs; utility install- <br /> ation, including water and sewage disposal, street <br /> lights, etc. <br /> 4, That all necessary easements to permit utility <br /> (electricity, telephone, sewer and water).inst- <br /> allation, servicing and hookups to the develop- <br /> ment shall be provided at no cost to the utility <br /> provider. <br /> 5. That sanitray sewer easements be shown on the final <br /> plat, for recording, so that when lots are sold, the <br /> owner of the system can maintain the system. <br /> 6. All plans for drainage, soil erosion and sedimentat- <br /> ion control sahll be reviewed and approved by Orange <br /> County. In addition, Orange County shall inspect the <br /> installation of control devices and the on going work <br /> for the total project. The project shall at all times <br /> meet the requirements of the Orange County Soil Erosion <br /> and Sedimentation Control Ordinance. <br /> 2-0 <br />
