DRAFT <br /> December 28, 1981 <br /> (undistributed) <br /> January 25 , 1982 <br /> February 1 , 1982 <br /> February 21 , 1982 <br /> THIS AGREEMENT, made and entered into this the day of <br /> , 1982 , by, between and among th-e—MTNTY OF ORANGE , <br /> a political subdivision of the State of North Carolina, THE TOWN <br /> OF CHAPEL HILL, and TOWN OF CARRBORO, municipal corporations <br /> duly created and existing under the laws of North Carolina, <br /> hereinafter for convenience referred to as a whole as "GovernmPn- <br /> tal Units" and ORANGE WATER AND SEWER AUTHORITY, a water and <br /> sewer authority created, organized and existing under the pro- <br /> visions of the Water and Sewer Authority Act contained in Chapter <br /> 162A of the General Statutes of North Carolina, hereinafter re- <br /> ferried to as OWASA; <br /> WITNESSETH : <br /> That for and in consideration of the public benefits expected to <br /> flow from the cooperative efforts of the Governmental Units , be- <br /> tween and among themselves from the establishment of coordinated <br /> and comprehensive planning within their respective areas of <br /> public concern, and. OWASA, that the parties to this Agreement do <br /> hereby mutually agree as follows : <br /> ARTICLE 1 . PURPOSE AND DEFINITION <br /> SECTEON 1 .1 PURPOSE OF THE AGREEMENT. <br /> The purpose of this agreement is to establish a method whereby <br /> coordinated and comprehensive planning may be provided for in t-.11 <br /> Orange County-Chapel Hill-Carrboro Joint Planning Area as deline- <br /> ated on the adopted Orange County Land. Use Plan Map and herein- <br /> after referred to as the Joint Planning Area. <br /> OWASA, ORANGE COUNTY, CHAPEL HILL and CARRBORO were created end <br /> exist under the laws of North Carolina and are bodies politic and <br /> corporate and exercising public and essential governmental func- <br /> tions to provide for the public health and welfare . It is under- <br /> stood and agreed that this Agreement is intended simply as an <br /> administrative agreement and procedure for the mutual coopration <br /> of the parties in dealing with the subject matter, and that the <br /> Agreement does not abridge or amend the statutory authorizations <br /> and responsibilities of the parties to the Agreement as exercis2 <br /> under the Statutes of North Carolina and regulations promulgated <br /> pursuant thereto. <br />
