It is bounded on the south by <br /> the northern boundary of the Transition Area as fixed by the <br /> Planning Board recommendation. Furthermore, the property lies <br /> mostly in the Bolin Creek Drainage.Basin and consequently drains <br /> away from the Duke Forest. <br /> Several years ago my clients considered a development for their <br /> property for single family residential use. They found that the . <br /> land would not meet the perk standards of Orange County in that <br /> testing indicated the soil throughout the tract to be unsuitable <br /> for septic tanks. Thus it appears that their property is <br /> virtually undevelopable for residential use without the <br /> availability of public sewer. They therefore are most anxious to <br /> have their land included in the Transition Area. I believe; <br /> though I have made only a general and not specific check, that my <br /> clients ' property is the only property in the 'Bolin Creek Basin <br /> no: included in the Transition Area. It at least includes a <br /> large majority of the excluded property which lies in the Bolin - <br /> Creek Basin. Furthermore, I believe that putting this property. <br /> to the residential use envisioned for the Transition Area would - <br /> be entirely compatible with the protection the Board is seeking <br /> for the Duke Forest area. As the Verner/Bernhard property drains <br /> away 'from Duke Forest properties, there should be no problems `( <br /> with from development activity leading to the � <br /> �._,.h erosion and runoff from Y g <br /> degradation of surface of endangered water habitats, threatened <br /> species and plant communities in the Duke Torest which was a <br /> major .expressed concern of the Administration and-the Planning <br /> Board. - <br /> I would also like to emphasize•,the questions raised by <br /> Commissioner Don Willhoit at the May 4th meeting with reference - <br /> to .a buffer consisting of those properties abutting Duke Forest. <br /> It would seem that such a provision would create a variable <br /> buffer depending on the depth of the respective properties - - <br /> abutting Duke Forest•, and would not be based on any planning need <br /> _c= the protection intended. . . . <br /> Please bring these matters to the attention of. the Planning Board . <br /> and other appropriate groups involved in the further study of <br /> this area to the end that the Board might deem it appropriate to <br /> - recommend- inclusion of my clients' property in, the Transition - <br /> Area as requested by the Town of Carrboro. <br />
