Board of Commissioners 5/4/517 Minutes <br /> 1 ' Commissioner Carey stated the importance of the Chair ser‘.....p01 <br /> 2 an ex officio member of any group involving the three governmental units 3 stating that this -is- a responsibility that goes along with being Chair. <br /> 4 It Wat7d4cided- that this recommendation would be reviewed at the- <br /> 410 first meeting -tft-Illecember. <br /> Commissioner Willhoit objected to the third recommendation stating <br /> 7 no need for this because no one has expressed an interest in talking about <br /> 8 extension of extra-territorial jurisdiction. <br /> 9 - Chair Marshall emphasized that the issue was raised when talking <br /> 10 about the swap of extraterritorial jurisdiction and it became quite clear <br /> 11 that there was one view of this intergovernmental cooperation and that it <br /> 12 was a territorial issue. Disenfranchisment was brought forward several <br /> 13 times at the public hearing. She feels it important that the citizens <br /> 14 understand that the Board is against moving people that are not in the <br /> 15 extra territorial jurisdiction into the extra-territorial jurisdiction and <br /> 16 that joint planning is the solution. <br /> 17 <br /> 18 Motion was made by Commissioner Carey, seconded by Commissioner <br /> 19 'Hartwell to instruct County members of the working intergovernmental group <br /> 20 to not consider, as a part of their deliberations, disenfranchisement of <br /> 21 county citizens through placing them in extra-territorial jurisdiction but <br /> 22 will emphasize and encourage intergovernmental cooperation to achieve <br /> 23 planning goals. <br /> 24 VOTE: UNANIMOUS. - - <br /> 25 <br /> 26 Commissioner Willhoit suggested that a more formal mechanism be <br /> 27 . put in place to inform each other on the Board of the various happenings <br /> 28 on the different groups that each. represent and Commissioner Halkiotis <br /> 29 suggested that this be reviewed after the budget process is finished. <br /> 30 <br /> :..:, 2. JOINT PLANNING AREA LAND USE PLAN <br /> (1) EXPANSION OF TRANSIT/ON AREA <br /> 33 Ill BOUNDARY DESIGNATION - TRANSITION AREA/RURAL BUFFER <br /> 34 ' (3) ORANGE COUNTY-CARRBOR0 ZONING JURISDICTION BOUNDARY <br /> 35 <br /> 36 Planning Board Chair Barry Jacobs presented the Planning Board <br /> 37 recommendation as stated below in the motion for approval. <br /> 38 <br /> 39 - Judith Wegner, ' member of the Carrboro Board, stated that there is a <br /> 40 consensus on the Carrboro Board that the swap idea should not be pursued. <br /> 41 The Board agrees with the representation suggestion and she stated that <br /> 42 . the _ legislation submitted* provides for that representation. If the <br /> 43 Planning Board recommendation is adopted, the Carrboro Board will review <br /> 44 • and . provide additional - comments . if. necessary. She emphasized that <br /> 45 continued dialogue is very important. <br /> 46 Commissioner Willhoit referred to the two designations to be <br /> 47 established for Duke Forest. He questioned the rationale for indicating <br /> 48 that those properties abutting Duke Forest will be kept out— of the <br /> 49 transition area and placed as part of the Rural Buffer. As part of the <br /> 50 Land Use Plan this property would have a buffer as it was developed. <br /> 51 Collins indicated that the buffer would be a condition placed upon any <br /> 52 of the land developed along the Duke Forest line. <br /> 53 Don Epling, Associate University Counselor at Duke, stated that they <br /> 54 are in the process of studying the purposes and goals for the use of Duke <br /> 55 Forest land. He indicated that Duke does not object to any particula- <br /> 411 land use plan presented to date. The study will take into account he <br /> development may impact and how that fits in. <br /> 58 10.1.4;. Pope spoke-en behalf of one-of-the landowners who owns 90 acres of <br /> 59 land south of Duke Forest. He referred to a statement made in the Planning <br /> 4- <br />
