. •
to the Duke Forest border. This would result in my clients
coming under the jurisdiction of two separate governmental
agencies in planning the development and the use of their entire
tract. If the Planning Staff recommendation were to be adopted,
then the property extending 400 feet from the Duke Forest border
into my clients' property would fall within the jurisdiction of
the Orange County Planning Board whereas the property of my
clients which lies 400 feet south of the Duke Forest would fall
within the planning jurisdiction of the Town of Carrboro.
One solution to this problem would be to adjust the Northern
Transition Area II boundary so as to coincide with the southern
boundary of the Duke Forest properties as suggested by the
Carrboro Board of Aldermen and in addition, in cooperation with
the Town of Carrboro, to retain a natural buffer of such distance
from the Duke Forest properties as to afford those properties,
the protection the Commissioners may determine is sufficient to
protect the public interest. This would result in all of the
property belonging to my clients coming under ' the single
jurisdiction of the Town of Carrboro. It may also result in
pushing development further from the Duke Forest.
Respectfully submitted,
C •
• E. K. Powe
Attorney for Messrs.
