3
Attachment 5 contains graphical presentations of the timeframes, as they pertain to the
resolution in Attachment 1.
At the December 5 BOCC meeting, the BOCC requested information on how many large
projects grandfathering may apply to. Staff has requested information from municipal planning
staffs but, as of agenda printing deadlines, had received information only from the Town of
Hillsborough. Information will be presented at the December 13 meeting, if it is available.
FINANCIAL IMPACT: Allowing for grandfathering of projects may result in a lesser amount of
school impact fee collections than might be collected if grandfathering, particularly for projects
with an approved ZCP, were not allowed.
SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goal is applicable to
this agenda item:
• GOAL: ESTABLISH SUSTAINABLE AND EQUITABLE LAND-USE AND
ENVIRONMENTAL POLICIES
The fair treatment and meaningful involvement of people of all races, cultures, incomes
and educational levels with respect to the development and enforcement of
environmental laws, regulations, policies, and decisions. Fair treatment means that no
group of people should bear a disproportionate share of the negative environmental
consequences resulting from industrial, governmental and commercial operations or
policies.
RECOMMENDATION(S): The Manager recommends that the Board:
1. Discuss the grandfathering topic as desired.
2. Adopt one of the attached resolutions as follows:
a. Attachment 1 if the BOCC desires to adopt the proposal made by staff at the
December 5 BOCC meeting.
b. Attachment 2 if the BOCC desires to adopt the additional language proposed by
Northwood Ravin for projects containing 100 or more dwelling units.
c. Attachment 3 if the BOCC desires to adopt the additional language proposed by
Northwood Ravin for projects containing 100 or more dwelling units and place an
outer limit on issuance of a Certificate of Compliance of December 31, 2020.
