8 <br /> 1 Craig Benedict referred to page 5-8, and said the existing code was too vague. He said <br /> 2 permitted and prohibited items need to be more specific. He said there will hopefully be an <br /> 3 opportunity, at a future work session, to vote on each item. <br /> 4 Chair McKee asked if this amendment were to be passed tonight, would the County be <br /> 5 locked in. He said there are many more steps before water and sewer can be expanded, and <br /> 6 he would not be comfortable with a 2 — 6 month delay. <br /> 7 Perdita Holtz said changes can be made at any time, via the usual amendment process. <br /> 8 She said there are other things that can continue to happen, while these items are being <br /> 9 hashed out. <br /> 10 Chair McKee said if the Board can continue this process and answer all its questions, he <br /> 11 would be in agreement with a short delay. He said each Commissioner should submit any <br /> 12 questions and concerns, address them in the near future, and move on with the process. <br /> 13 Commissioner Jacobs said he agrees with Chair McKee, and this item should come <br /> 14 back at a December meeting. <br /> 15 Chair McKee asked staff if this timeframe is acceptable. <br /> 16 Perdita Holtz said this timeframe would be possible as long as the Commissioners have <br /> 17 any questions submitted in a week. <br /> 18 Chair McKee said the Board can move quickly. <br /> 19 Commissioner Pelissier asked if staff would exclude a permitted use if only one Board <br /> 20 member wanted to exclude. <br /> 21 Commissioner Dorosin suggested all Commissioners send in their list, and if four or <br /> 22 more agree to remove a use, then staff should remove it from the listing. He said if there are <br /> 23 three or less votes to remove an item, the Board should review and vote on each. <br /> 24 Commissioner Price asked if the Board is reviewing the multicolor lists or the NAICS list. <br /> 25 Chair McKee said it is his understanding that the Board will receive a list of deleted <br /> 26 items from the 70 pages of numbered items; the NAICS codes. <br /> 27 Commissioner Price asked if the decisions will pertain to the Hillsborough EDD. <br /> 28 Perdita Holtz said the outcome will have to be included in the tables of permitted uses, <br /> 29 but staff can send the Board a list of the sector numbers that are in the EDDs, to make things <br /> 30 easier. <br /> 31 Commissioner Rich asked if staff will provide a list. <br /> 32 Perdita Holtz said yes. <br /> 33 John Roberts said the BOCC is able to send it back to the Planning Board with <br /> 34 instructions. <br /> 35 Chair McKee said it is now on the Board's table, and he believes the Board should go <br /> 36 through the list. <br /> 37 Commissioner Rich clarified that the Commissioners will review a list, and then provide <br /> 38 any input or questions back to staff within a week. <br /> 39 Perdita Holtz said she would provide the Board with the list by tomorrow morning. <br /> 40 John Roberts said staff counting votes outside of a public meeting would be a violation <br /> 41 of the Open Meetings law. <br /> 42 <br /> 43 A motion was made by Commissioner Dorosin, seconded by Commissioner Rich to <br /> 44 delay action on this item and continue the public hearing to the December 5th BOCC meeting; <br /> 45 staff will provide the NAICS list to the BOCC; the Board will review and respond by Tuesday of <br /> 46 next week (Nov. 8th)with any NAICS listed uses that the Board would like prohibited in the <br /> 47 Hillsborough EDD; staff will collect data and the BOCC will make all decisions in an open <br /> 48 meeting. <br /> 49 <br /> 50 VOTE: UNANIMOUS <br />
