Article 5: Uses 55 <br /> Section 5.6: Standards for Commercial Uses <br /> (a) The amount of water anticipated to be used on a daily, weekly, mont► y, <br /> and annual basis by regulated uses located on the parcel (e.g., w. er <br /> usage by bona fide farm uses is not required to be included); <br /> (b) An analysis of the amount of groundwater withdrawal consi►-red to be <br /> safe and sustainable in the immediate vicinity; and <br /> (c) An analysis of whether other wells in the vicinity oft proposed use are <br /> expected to be affected by withdrawals made by tr- proposed use. <br /> 5.6.15 Sexually Orient- Businesses <br /> (A) Submittal Requirements <br /> (1) In additio to the site plan submittal criteria .' ailed within Section 2.5 of this <br /> Ordinance t' - applicant shall submit proo . license has been issued allowing for <br /> the operation o . sexually oriented bu ess in accordance with Chapter 8 of the <br /> Orange County C.re of Ordinances <br /> (B) Standards of Evaluation <br /> (1) Sexually oriented busines shall not be located in any building, or portion <br /> thereof, that is: <br /> (a) Within 1,000 fret of an e ting sexually oriented business. <br /> (b) Within 1,0I feet of a: <br /> (i) Residential land use incl •ing any open space established as <br /> part of the residential subdi ion approval process, <br /> Church and/or place of worship, <br /> (iii) School (public, private, or specialty), <br /> (iv) Public or private library, <br /> (v) State licensed child care facility, or <br /> (vi) Public park or recreational facility. <br /> (c) Measurement shall be made in a straight line, without regard . the <br /> intervening structures or objects, from the nearest portion of the •uilding <br /> or structure used as the part of the premises where a sexually orie' ed <br /> business is conducted to the nearest portion of a building, structure, . <br /> open space area of a use listed above. <br /> 5.6.16 Retail Trade(Sectors 44, 45; excluding cubcector 45442 of the North American Industry <br /> Classification System [NAICS])43 <br /> (A) Standards for EDH-4 and EDH-5 Zoning Districts <br /> (1) Retail Trade uses are permitted in the EDH-4 and EDH-5 zoning districts only in <br /> accordance with the following standards: <br /> (a) The retail trade use(s) is part of an overall site plan that includes at least <br /> one other permitted Principal Use. <br /> (i) The other permitted Principal Use(s) must be established prior <br /> 42 The version of the amendments the Planning Board reviewed included this language but did not include <br /> standard (2). The language was revised based on comments made by the Attorney's office;the intent of the <br /> language is unchanged. <br /> 43 These standards are being proposed in order to allow for some by-right mixed-use projects in the Hillsborough <br /> EDD while ensuring the scope of the overall project is not predominantly retail trade.
