2 <br />addressing planning issues fora 900+ acre area in the northeast corner of Orange County. <br />A key issue addressed by the Task Force has been non-conforming, non-residential land <br />uses and the effect on existing and future land use in the area. Additional issues included <br />traffic and access management, water quality and quantity, noise and noxious odors, and <br />an appropriate level of residential and non-residential development. Traditional rezoning <br />and special use- permit processes were not felt to afford the community sufficient protection <br />and assurances of maintaining a rural life style and character. The Task Force is <br />suggesting that a Rural Economic Development Area (REDA) be created to facilitate a <br />process to bring non-conforming activities into compliance. <br />3. Land Use Element Text Amendments: Text Amendments to Section 3.3 entitled "Land <br />Use Plan Categories" to amend the definition of the "10-Year Transition" category and to <br />Section 4.0 entitled "Implementation and Evaluation" to amend the "Land Use Element - <br />Zoning District Matrix" to potentially allow non-residential uses in designated 10-Year <br />Transition areas in accordance with adopted small area plans and/or zoning overlay <br />districts as being considered in the Efland-Mebane Small Area Plan Implementation <br />Focus Group. <br />4. Sedimentation and Erosion Control Ordinance: The NC Department of Environment <br />and Natural Resources (DENR) Land Quality Section has completed a technical audit of <br />the County's Erosion Control program and suggested 15 amendments/changes designed <br />to strengthen the County's Ordinance and enhance compliance with the State's 2006 <br />Model Ordinance. <br />5. Orange County Stormwater Ordinance for Lands within the Neuse River Basin: <br />Text amendments to the Orange County Stormwater Ordinance for Lands within the <br />Neuse River Basin to reflect changes in the Nitrogen Reduction Offset payment <br />calculation. The proposed amendment will replace the specific calculation method with a <br />statement that the offset payment will be calculated based on the current State of North <br />Carolina requirements. <br />6. Orange County Zoning Ordinance: Text amendments to Article 4.3 Permitted Use <br />Table and Article 6.29 Development Standards for Economic Development (ED) Districts <br />to add performance criteria for retail establishments including and amended review and <br />approval process and categorization of low-intensity non-residential use. <br />B. NON-PUBLIC HEARING ITEMS <br />1. Agricultural Support Enterprises: Planning and Economic Development staff will <br />provide an update on the proposal to create a new conditional district rezoning process <br />for agriculturally related businesses. Unlike general rezoning, property subject to the <br />conditional district rezoning process may be used only for a specific land use(s) based on <br />asite-specific development plan. The Board of Commissioners~will be asked to endorse <br />three key concepts: 1) amend the Land Use Element of the Comprehensive Plan and <br />Zoning Ordinance to allow conditional district zoning; 2) prepare clear performance <br />standards; and 3) create the Agricultural Support Enterprises Manual. <br />Note: The conditional district rezoning process could be used countywide and not <br />just for the Agricultural Support Enterprises proposal. <br />
