Delete Subparagraph 3.15.2 and insert in its stead the following new <br /> Subparagraph 3.15.2: <br /> 3.15.2 If the Contractor fails to clean up during construction or at the completion <br /> of the Work, the Owner may do so as provided in Paragraph 2.4 and the cost <br /> thereof shall be charged to the Contractor. <br /> Paragraph 3.18 "INDEMNIFICATION" <br /> 1. Revise Subparagraph 3.18.1 by deleting from the first sentence the words: "...and <br /> to the extent claims, damages, losses or expenses are not covered by Project <br /> Management Protective Liability insurance purchased by the Contractor in <br /> accordance with Paragraph 11.3,...". <br /> 2. Add a new Subparagraph 3.18.3 as follows: <br /> 3.18.3 As a condition of payment by the Owner of Contractor's Applications for <br /> Payment, the Contractor shall further indemnify and hold harmless the Owner <br /> and its sureties and Architect from any claims, damages, loss or expense, <br /> including Owner's attorney fees, relating to or on account of any lien or claim of <br /> lien asserted by any laborer, materialman, subcontractor or any other person <br /> directly or indirectly acting for, through, or under Contractor against the Project <br /> or any part thereof or any interest therein or against monies due or to become due <br /> from Owner, its sureties or agents; without limiting the foregoing, Contractor <br /> shall cause any lien or claim of lien to be removed, satisfied, or discharged within <br /> 10 days from the date of filing or receipt by the Contractor,whichever is sooner. <br /> V. MODIFICATIONS OF ARTICLE 4-ADMINISTRATION OF THE CONTRACT <br /> A. Paragraph 4.2 "ARCHITECT'S ADMINISTRATION OF THE CONTRACT" <br /> 1. Delete Subparagraph 4.2.2 in its entirety and insert in its stead the following new <br /> Subparagraph 4.2.2: <br /> 4.2.2 The Architect will visit the site at intervals appropriate to the stage of <br /> construction to become familiar with the progress and quality of the completed <br /> Work and to deteimine in his professional opinion whether the Work is being <br /> performed in a manner indicating that the Work, when completed, will be in <br /> accordance with the Contract Documents. On the basis of on-site observations as <br /> an architect, the Architect will keep the Owner informed of progress of the Work <br /> and will endeavor to guard the Owner against defects and deficiencies in the <br /> Work. The Architect will neither have control over or charge of, nor be <br /> responsible for, the construction means, methods, techniques, sequences or <br /> procedures, or for the safety precautions and programs in connection with the <br /> Work, since these are solely the Contractor's rights and responsibilities under the <br /> Contract Documents, except as provided in Subparagraph 3.3.1. <br /> 2. At the end of Subparagraph 4.2.3 insert the following: "Nothing in this <br /> Paragraph,however, affects the obligation of the Architect to review the progress <br /> of the Work with sufficient frequency and detail to fulfill the obligations set out <br /> SGC -7 <br />
